Your Committee on Public Works and Intergovernmental Relations, to which was referred
Communication No. 39 and attached Resolution No. 12-01, reports as follows:
Communication No. 39, dated December 8, 2000, is from Deputy Corporation Counsel Gerald Takase
transmitting for Council's review and consideration Resolution No. 12-O1 authorizing the acceptance and
dedication of Road Lot A along with three drywells within said roadway, in Pu`ukapu Homesteads, from
the Trustees of the Richard Smart Revocable Personal Trust and identified as Tax Map Key (3)6-4-01-
042 (portion). Letters from the Planning Department, Water Department, and Public Works Department
supporting the acceptance of the subject roadway are also attached to Communication No. 39.
Resolution No. 12-0 l states that the developer, Trustees of Richard Smart Revocable Personal Trust, have
constructed all subdivision improvements and received final subdivision approval. In addition, the
resolution also states that the subject road and drainage improvements are in acceptable condition for
dedication and in full compliance with the provisions of Chapter 22 of the Hawaii County Code. Exhibit
A, the dedication deed and Exhibit B, a map further delineating the road parcel, are also attached to the
resolution.
In Committee meetings held previously on January 9, 2001 and August 14, 2001, Resolution No. 12-01
was deferred. Issues of concern included the receipt of a project punch list and an error in the survey
description for Course No. 1 1. Communication No. 39.1, dated March 9, 2001, from Mr. Galen Kuba of
the Department of Public Works, provided the Committee with clarification on both matters. However, to
prevent further confusion, Resolution 12-01 was amended to contain only the corrected survey documents
as an attachment. Communication 39.2, dated August 14, 2001, from Mr. Gerald Takase, Assistant
Corporation Counsel, transmits Resolution 12-O1, Draft 2 with the corrected description.
Your Committee is in accordance with the purpose and intent of Resolution No. 12-O1, Draft 2, and
recommends its adoption.
