HomeMy WebLinkAboutREP PC 039 08/28/2001 2000-2002 REPORT OF THE COMMITTEE ON PLANNING DATE: August 28, 2001 RE: C-298/Bill No. 88 PLACE: Councilroom TIME: 3:03 p.m. Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No. 88, transmitted by Mayor Harry Kim per Communication No. 298, dated August 7, 2001, regarding the Change of Zone request by William. V. Brilhante at Waiakea, South Hilo, Hawaii, TMK: 2-2-37:27, reports as follows: Bill No. 88 amends Ordinance No. 87-110, which amended Section 25-8-33 (City of Hilo Zone Map), Article 8, Chapter 25 (Zoning Code) of the Hawaii County Code, by changing the district classification for approximately 21,050 square feet of land from a Single Family Residential (RS-10) to a Limited Industrial (ML-20a) zoned district. The rectangular-shaped subject property, owned in fee by the applicant, is located on Kanoelehua Avenue between Leilani and Lanikaula Streets. The now vacant lot is being used as a parking lot for vehicles. Ordinance No. 87-110, approved on October 28, 1987, proposed to construct a 4,500 square foot warehouse building on the subject property. On September 6, 1989, the Planning Director granted cone-year administrative extension of time for Condition B (secure final plan approval) until October 28, 1989. The applicant is now requesting an amendment to Condition B for two years to secure Final Plan Approval; however, the Planning Commission has recommended five years because of unforeseen circumstances which can delay a project. As the economy slowed, the original prospective tenant found and leased a smaller building. Over the years, the applicant was approached by other prospective tenants to build, but due to the slow economy and high interest rates, the applicant was not able to build an affordable structure. The applicant is in the final stages of completing a warehouse building on another lot at the corner of Hualani and Kanoelehua Avenue. Recently, someone approached the applicant about constructing a building on the subject site, so the applicant is pursuing the time extension. The State Land Use designation is Urban. The General Plan LUPAG Map designates the area for Industrial uses. The County Zoning is Limited Industrial (ML-a). The ALISH designation is Urban development. The subject property is not situated within the Special Management Area. The subject property is located within Zone "X", an area determined to be outside the 500-year flood plain. PC-39 PC-39 Page 2 August 28, 2001 The adjacent properties to the north (makai) are zoned ML-20 and include Magoo's Auto Parts, Hawaii Printing Corporation and Stationer's Corporation. West and to the rear are lands zoned RS-10. The property to the south (mauka) is zoned RS-10 with a single family dwelling. Approximately 100 feet south (mauka) is a vacant property recently rezoned from RS-10 to MCX-20. On the corner of Lanikaula Street and Kanoelehua Avenue is the building where Harmony Music Studio and Osaka Restaurant are located on ML-20 zoned lands. Across Kanoelehua Avenue to the east are lands zoned MG-la. Access to the property is from Kanoelehua Avenue, a State highway. The lanes fronting the subject property are one way and southbound. Water is available to the property. All utilities and services are available to the property. Bill No. 88, Draft 2, which includes housekeeping amendments to reformat the document to the current format and the standard language used, was circulated and approved by Your Committee. Committee Member Curtis Tyler reiterated some of the background information and questioned why the Planning Commission proposed a term of five years for Final Plan Approval when the original request was for two years. Mr. Brilhante replied that it was probably because "there's a lot of things that come into play" over time. Mr. Tyler also recommended that Condition I be amended to simply state that further extensions would have to come to the Council for approval. He also proposed to amend Condition E to state "There shall be only one access from Kanoelehua Avenue and it shall meet with the approval of the State Department of Transportation." Your Committee did not entertain further discussion on this measure. Your Committee concurs with the Planning Commission and the Planning Director for recommending a favorable consideration for the Change of Zone request. Your Committee on Planning is in accord with the intent and purpose of Bill No. 88, Draft 2, as amended to Bill No. 88, Draft 3, and recommends it pass first reading.
