RESOLUTION AUTHORIZING THE GRANT OF EASEMENT FOR A TELECOMMUNICATION CONDUIT EASEMENT EETWEEN PRINCE JONAH KUHIO KALANIANA`OLE ELEMENTARY AND INTERMEDIATE SCHOOLS (TMK (3) 2-7-25:04 and 2-7-22:02) AT KA`APOKO, DISTRICT OF SOUTH HILO, ISLAND, COUNTY AND STATE OF HAWAII, TO STATE OF HAWAII, DEPARTMENT OF EDUCATION. WHEREAS, the County of Hawaii is the owner of the Old Government Main Road, which is the right of way fronting Prince Jonah Kuhio Kalaniana`ole Elementary and Intermediate Schools, located at Ka`apoko, District of South Hilo, Island, County and State of Hawaii, specifically identified and being more particularly delineated on Exhibit "A" (map), said exhibit prepared for the State of I-Iawai`i Department of Accounting and General Services; and WHEREAS, THE STATE OF HAWAII DEPARTMENT OF EDUCATION AND DEPARTMENT OF ACCOUNTING AND GENERAL SERVICES need the grant of easement to construct, reconstruct, repair, maintain and operate pole and wire lines and/or underground conduits and lines and to use such appliances and equipment as may be necessary for the transmission of telecommunications, within the County's property; and WHEREAS, Section 2-111 of the Hawaii County Code requires that the Council, by resolution, authorize the Grant of Easement from the County of Hawaii, subject, however, to reversion to County of Hawaii upon termination or abandonment of the easement for the specific purposes for which it was granted. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with Section 2-111 of the Hawaii County Code, that the County of Hawaii authorizes a grant of easement for the construction, reconstruction, repair, maintenance and operation of pole and wire lines and/or underground conduits and lines and to use such appliances and equipment as may be necessary for the transmission of telecommunications, to the State of Hawaii Department of Education, as delineated on the map submitted by the State of Hawaii Department of Accounting and General Services attached hereto, over the Old Government Main Road shown thereon, until termination or abandonment of that specific purpose, to the State of Hawaii, Department of Education, its successors and assigns.
