AN ORDINANCE AMENDING THE HAWAII COUNTY CODE 1983 (1995 EDITION) TO REPLACE REFERENCE TO "CHIEF ENGINEER" WITH "DIRECTOR OF PUBLIC WORKS." BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. The following sections of the Hawaii County Code 1983 (1995 edition) are hereby amended by replacing every reference to "chief engineer" with "director of public works": chapter 2, article 1, § 2-5 Chapter 10, article 1, section 10-1, of the Hawaii County Code 1983 (1995 edition), is amended by deleting the following item: [(1) "Chief engineer" means the chief engineer, department of public works, County of Hawaii, or his duly authorized representative.] SECTION 4. Chapter 14, article 11, section 14-67, of the Hawaii County Code 1983 (1995 edition), is amended by deleting the following item: [(1) "Chief engineer" means the chief engineer of the County.] SECTION 5. Chapter 22, article 1, division 8, section 22-33.1, of the Hawaii County Code 1983 (1995 edition), is amended by deleting the following item: -7- [(2) "Chief engineer" means the chief engineer of the public works department of the County of Hawai`i.] SECTION 6. Chapter 22, article 3, division 2, section 22-51, of the Hawaii County Code 1983 (1995 edition), is amended by deleting the following item: [(1) "Chief engineer" means the engineer as provided for in section 6-2.2 of the Charter.] SECTION 7. Chapter 22, article 4, division 1, section 22-72, of the Hawaii County Code 1983 (1995 edition), is amended by deleting the following item: [(8) "Chief engineer" means the chief engineer of the County or his duly authorized representative.] SECTION 8. Chapter 23, article 1, section 23-3, of the Hawaii County Code 1983 (1995 edition), is amended by deleting the following item: [(5) "Chief engineer" means the chief engineer of the department of public works of the County.] SECTION 9. Chapter 27, article 2, section 27-12, of the Hawaii County Code 1983 (1995 edition), is amended by deleting the following item: [(9) "Chief engineer" means the chief engineer of the County of Hawaii or his authorized representative.] SECTION 10. Material to be repealed is bracketed. New material is underscored. In printing this ordinance, the brackets, bracketed material and underscoring need not be included. SECTION 11. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. -8- SECTION 12. This ordinance shall take effect upon its approval.
