SUBJECT: DRAFT 2 BILL TO AMEND CIIAPTER 22 -STREETS & SIDE~VALI~S
This is in response to the concerns raised your July 27, 2001 memorandum.
1. meals Process -References to the Board of Appals are found in Section 22-8.2. (e), (f) and (g).
2. Corrranercial Use of Streets -Because commercial uses will involve property management issues
such as rental rates, collection of rent, default provisions, etc., our Finance Department should
handle this matter. For your information the Finance Department is looking into the feasibility of
establishing a property manager. The property manager will be responsible for the sale, leasing,
licensing or permitting of County real property. This Department will work with the property
manager to advise him of impacts on public works facilities.
3. Police Depart~rtent -Comments were solicited from the Police Department. A copy of their
comments is attached. Civil Defense and Fire were not contacted as there are no issues that directly
affect them. We will solicit comment from them before we submit Draft 2.

RE: Chapter 22 -Streets And Sidewalks IPevisions
Forwarded for your review are the minutes from workshops held on February 7 and March 22,
2001 in relation to the above matter. This information should assist you in preparing a second
draft for Committee review. After further review of Bill No. 225, I present the following items
for your consideration.
Appeal Process Section/Clause -The current draft of the bill does not include one. Identifying
the Board of Appeals may be appropriate.
Commercial Use Of Streets -All other county codes presently make provisions for Peddler
Permits and also exempt flowers and vegetables from needing such. The intent of Bill No. 225 is
to do away with Peddler Permits, etc. and have the Council issue licenses or negotiate leases for
these individuals pursuant to Hawaii County Code, Chapter 2. To accomplish these changes will
the Council need to adopt a clear policy for your department to implement? Or is your
department already prepared to handle the application process and then refer it the Council?
Police Department -Forwarded recently to you, by Legislative Assistant Charmaine T. Doran
was a draft bill to amend Chapter 22 from Capt. John Dawrs and Deputy Managing Director
Peter Young. It is apparent that many departments may have forgotten or are unaware of your
efforts with this chapter. Forwarding this draft to the Police Chief as well as other affected
departments like Fire and the Civil Defense Agency for comment may prevent further efforts
from overlapping. To ensure a thorough review it could be necessary for you to conduct amini-
workshop for these individuals. I know this comprehensive intergovernmental approach for
county legislation is not common place, but knowing where these departments stand will be
helpful to the Council, especially from the point of support.

SUBJECT DRAFT 2 ®CHAPTER 22/ COUNTY STREETS
We offer the following comments to your request for review of draft 2 of Chapter 22 relating to
County Streets:
Section 22-4 4 Construction Permits; Conditions.
• The applicant should be responsible for notifying all ~f~~d property
owners/lessees fran~fing ~E IorE o€ t-he proposed construction prior to
commencing.
• When the work interferes with private driveways, the applicant shall provide
for a safe passageway of vehicles around or through the work area.
Section 22-5 9 Standards for Posting Building Numbers.
• (a) Numbers may be affixed "consaicuously" to a building...
• (b) The last sentence should read, "When the driveway provides access to
more than one building, the assigned numbers, in addition to being_posted at
the entrances or mailbox, shall be posted on each of the buildings."
• Any visual obstructions, i.e. vegetation, shall be cleared by the property
owner so building numbers can be easily seen from the roadway.
• If numbers posted on mailboxes, should they be affixed on both sides when
roadway is a through street?
Section 22-8.2 to 8.3
• We understand that the Department of Public Works will be responsible for
enforcement of the chapter. ,
