The following highlights of the HSAC B~e~utive Committee meeting of October 8, 2001 are hereby
submitted for your review and information.
I. Cali to Order: The meeting was called to order at 9:00 a:m. In the absence of HSAC President
Jon Yoshimura, the meeting was chaired by HSAC Vice President. J. Curtis Tyler, III.
II. Minutes: The Secretary's minutes of the HSAC Executive Committee: meeting of September
10, 2001 were approved.
III. Treasurer's Report: The Treasurer's Report for August, 2001 was approved (copy attached).
IV. Reports:
A. Egeeutive Coanpnittee Reports: Two Executive Committee reports submitted by-HSAC
Secretary Dain P. Kane were reviewed and approved.
• The first report, dated September 17, 2001, related to an HSAC Executive Con~~nittee

County Reports: The Counties of Hawaii, Maui and Kauai, respectively, reported that their
councils had adopted resolutions condemning the September 1 1, 2001 terrorist attacks on the
United States and expressing support for the President of the United States in his efforts to
defend the nation. These resolutions were requested by the National Association of Counties.
J. Curtis Tyler, III reported to the HSAC Executive Committee that, due to budget constraints,
Hawaii County's assigned HSAC staff, Rory Flynn, would not routinely travel to Honolulu for
HSAC meetings, but would continue to provide staff support via phone/email contact and
written transmittal of HSAC actions.
C. NACo Report: J. Curtis Tyler, III reported that he has been appointed by NACo President
Javier Gonzalez to Chair the Water Quality Subcommittee of the Environment Energy and
Land Use Steering Committee. Mr. Tyler will be attending a scheduled leadership meeting of
the Environment Energy and Land Use Steering Committee in Washington, D.C. in mid-
November to develop strategies and programs for the next year.
V. Unfinished )Business:
A. 2002 I~SAC Legislative Program Policy Statement: All four counties approved the 2002
HSAC Legislative Program Policy Statement transmitted by HSAC President Jon Yoshimura
on August 13, 2001. The statement directs that "HSAC shall be guided by the following
policies during the 20021egislative session:
1. The Executive Committee shall determine the strategy for HSAC's efforts before the
legislature.
2. An HSAC officer or designee shall testify before the legislature on proposals in the 2002
HSAC Legislative Package."
Dain P. Kane proposed that each county council adopt an additional policy to amend HSAC's
legislative program policy statement, as follows:
"Due to the time sensitive nature of legislative matters, the HSAC Executive Committee
requests that the counties amend the 2002 HSAC Legislative Policy Statement to include
authorization for the HSAC Executive Committee to add items to the 2002 HSAC Legislative
Package during the legislative session if the measures will promote the counties' home rule
authority and/or increase the counties 'revenues. "
Consideration of Proposals for the 2002 HSAC Legislative Package: In lieu of receipt of
proposals from members of the Hawaii County Council as requested in a memorandum from
the undersigned dated September 6, 2001, a list of proposals (attached) assembled by Finance
Director William Takaba was discussed by the HSAC Executive Committee.
In his memorandum of October 6, 2001 Ron Kouchi, HSAC Treasurer, transmitted the
following listing of carryover bills from the 2001 Legislative session which were part of the

Recreational Activities 2002 Regular Session
To reaffirm its support for tort liability/public beach parks legislation, each county council is
requested to affirm support for SB 796.
Kauai County has legislation to amend Sections 520-1 and 520-2, HRS, relating to landowner's
liability, which "extends to the Counties the limitation of liability currently afforded to private
landowners who make their land and water areas available to the public for recreational
purposes." A copy of Kauai County's proposed bill is appended to this report.
Maui County has proposed legislation to enable the counties to impose and collect traffic fines,
to designate a percentage of liquor license fees for the funding of
education/prevention/treatment programs to address alcohol abuse.
C. Seed Money for HSAC Mid-Year Conference. The Executive Committee approved the
transmittal of $1,000 to the City and County of Honolulu to assist in costs for the HSAC Mid-
Year Conference in December, 2001.
D. HSAC Mid-Year Conference. The theme of the conference has been changed to "Re-
Thinking and Rebuilding Hawaii's Economy." The new dates for the Mid-Year HSAC
Conference are December 17-18, 2001.
VI. NEB' BUSINESS. None
VII. COMMUNICATIONS: The HSAC Executive Committee acknowledged receipt of a letter from
J. Curtis Tyler, III dated September 26, 2001, and check in the amount of $2,376.12 payable to
HSAC representing the balance of funds in the WIR 2001 Conference account. The letter
transmitted the final WIR 2001 financial report, showing conference expenditures and revenues.
VIII. ANNOUNCEMENTS: The chairman requested that all counties share 2002 Council meeting
calendars to help determine HSAC's 2002 Executive Committee meeting dates and conferences.

B. County Reports
Vice President Tyler reported that Hawaii County Council had
approved the HSAC Officers for Fiscal Year 2001-2002 and
nominees for NACo and WIR Boards of Directors on July 31, 2001.
Correspondence dated August 1, 2001 from Hawaii County Clerk,
AI Konishi, reporting the same was received.
C. NACo Reports
Vice President Tyler reported on the NACo conference in
Philadelphia held on July 13-17, 2001. He noted that Hawaii was
well represented. The Executive Committee agreed that the 2005
conference to be held in Hawaii needs to be promoted ahead of
time and a badge or pin should be used as part of the promotion.

There was no unfinished business.
VI. NEW BUSINESS \
A. Discussion of Proposals for the 2002 HSAC Legislative Package ~y
Vice President Tyler indicated that Hawaii County Council is in the
process of discussing proposals.
Treasurer Kochi indicated that he was glad that the vicious dogs
law was passed during the last legislative session. He also
indicated that an area to watch in the coming session will be the
powers and duties of the State Department of Agriculture, Land
Use Commission and Board. Upcoming legislation may impact
County authority to regulate land uses.
Based on Vice President Tyler's inquiry, Secretary Kane and
Treasurer Kouchi provided the history of HSAC's beach liability bill
in the 2001 Legislature.
Secretary Kane indicated that Maui County Council's Committee of
the Whole has agreed to submit three proposals. The first proposal
would provide the counties with the option to delegate their
authority to accept the dedication and surrender of roadways and
roadway lots. The second proposal would allow the counties to
impose and collect additional fines for traffic violations. Alternate
Hokama indicated the third proposal would designate a percentage

of liquor license fees to fund education, prevention and treatment
programs designed to address alcohol abuse. Secretary Kane
requested the opportunity for the Maui County Council to submit
additional proposals.
President Yoshimura requested that additional proposals be
provided in writing no later than October 8, 2001 at the next HSAC
Executive Committee Meeting.
13. 2002 HSAC Legislative Program Policy Statement
Hawaii County -reported approval of the proposal on August 29,
2001
Kauai County ,reported that its approval has been moved out of

C. HSAC Mid-Year Conference
President Yoshimura indicated that the Honolulu City and County
would be hosting the mid-year conference in December in order to
provide Hawaii County with relief due to their hard work and efforts
in hosting the last WIR conference in Waikoloa.
Honolulu City and County Staff Sean Casey reported that the
tentative date for the mid-year conference is November 29 and 30,
2001 at the Hawaii Prince Hotel. The cost will be $150 for early
registration and $175 for late registration. Rooms will be available
with ocean views far $125 per night. Mr. Casey is currently working
on arranging for tickets for conference members to attend the
University of Hawaii football game scheduled to be played at the
Aloha Stadium on Saturday, December 1, 2001.
Vice President Tyler noted a scheduling conflict with a NACo
conference on the mainland during the same time period.
Treasurer Kouchi noted that one invoice has still not been
submitted for the Year-End Conference held on Kauai, but when it
is remitted, the net to be credited to HSAC is befween $5,000 and
$6,000.
Mr. Casey requested that the matter of the release of early funds
be placed on the next agenda.

D. HSAC 2002 Calendar
Vice President Tyler requested that this matter be taken up at the
next Executive Committee meeting and that copies of the various
Council's calendars be circulated.

VIII. ANNOUNCEMENTS
President Yoshimura wished Vice President Tyler a Nappy Birthday.
President Yoshimura announced that the next meeting will be held on
Monday, October 8, 2001 at 9:00 a.m. at Nonoluiu Hale.

Dear Mr. President:
Pursuant to Section 20 of the Bylaws of the Hawaii State Association of
Counties (HSAC), which requires a report of each official action, the following
reports on the approval of nominees to serve on the NACo and WIR Board of
Directors.
Your Committee notes that Section 18 of HSAC's Bylaws includes a
provision which stipulates in relevant part that "[t]he corporation shall be
responsible and pay for the travel expenses of... [m]embers of a council who
serve on the board of directors of the National Association of Counties or
Western Interstate Region in the conduct of official business as directors°.
Further, Article VI of NACo's Bylaws stipulates in relevant part that "[t]he state
association shall submit a nomination to the NACo President for each
category.... Each nomination shall be submitted in a duly authorized resolution
of the governing body of said state association".
As such, official action on the part of the Executive Committee is required.
Your Committee voted to recommend the following nominees for possible
appointment to the NACo Board of Directors:

TITLE: RELATING TO LANDOWNI?R'S LIABILITY
PURIPOSE: Extends to the Counties the Vanitation of liability currently Forded to
private landowners who snake their land and water areas available to the
public for recreational purposes.
MEANS: Amends Sections 520-1 and 520-2, Iiawaii Revised Statutes.
JiJSTIFICATION: Limiting the liability exposure of counties for injuries occuariztg on
County lands that are made available to the public for recreational
purposes will encourage the Counties to develop more public recreational
areas, to work in concert with land owners and developers to provide
increased recreational opportunities for the public, aid allow the counties
to focus on and to expend monies on improvements and infrastructures
that will benefit a greater number of people rather than on insurance,
expeiaseve litigativra, defense costs and potential judgments.

SECTION 1. Sections 520-1 and 520-2, I€awaii Revised Statutos, are amended to read as
follows:
"520m 1. Purposes.
°The purpose of this chapter is to encourage ow~aers of land to make lagid and water areas
available to the public for recreational purposes by limiting their liability toward persons enteriaag
thereon for such purposes d.,ctesad ~1e same 'rya°tation of liability to the va~ous Co,~tles.
520-2. Definitions.
t1s used cry this chapter:
"Cl~rge" means the adrsaission price or fee in return for invitation or permission to enter yr go
upon the land.
"House guest" means any person specifically invited by the owner or a member of he owner's
household to visit at the owner's home whether for diaax9er, or to a panty, for conversation or any
other similar purposes iiacluding for recreation, and includes playmates of the owner's rgainor
chf ldren.
"Land" means land, roads, water, water courses, private ways and buildings, structures, and
machinery or equipgnent wkaen attached to realty other than lands owned by the government].
"®`vner" rraeaas the possessor of a fee interest, a tenant, lessee, occupant, or person in control or
the premises and inclu~ the various Counties.
°°Recreational purpose" includes but is not limited to any of the following, or any coggabiraation,
thereof haayating, dishing, swiaaanaigag, boating, cagnping, picnfclcigag, lacking pleasure driving,
nature study, water slciigag, winter sports, egad viewing or enjoying historical, archaeological,
scenic, or sccezatific sites.
°°Recreational user" means away person who is on or about the premises that the owner of land

Pursuant to Section 1(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the HSAC Executive Meeting
Report of October 8, 2001 transmitted by Councilman J. Curtis Tyler, III, HSAC Vice President,
be waived from the Committee on Public Works and Intergovernmental Relations to the full
Council for immediate action and consideration. In reviewing this matter, timely approval is
crucial. It is therefore advantageous that approval is granted and the matter placed onto the next
Council agenda for review. However, in the event this request is denied, for whatever reason, I
understand the matter shall be referred to the Committee on Public Works and Intergovernmental
