Thank you for your letter dated August 27, 2001, containing an annual progress report for
the proposed development as required under Condition P of Ordinance No. 98-66. We
understand that along with the change in ownership, a new subdivision application has
been filed (SUB No. 01-128) and SUB 96-116 is being withdrawn. We also confirm that
the rezoning file name will be changed to Hawaii Agribusiness, LLC. with Thomas
Yamamoto as the contact person.
Below we provide you with our findings with regard to compliance with the conditions of
Ordinance No. 98-66.
Condition B: The Planning Department received your letter and attachments dated
October 16, 2001 providing documentation regarding the consummation
of a water agreement in compliance with this condition. Therefore, the
effective date of the change of zone is May 4, 2000, the date of
compliance with Condition B.
Condition D: A conceptual Master Plan was received by the Planning Director on
October 12, 2001 in compliance with this condition.

Condition I: The archaeological mitigation plan was received by the Planning Director
on August 29, 2001 and forwarded to DLNR-HPD for their review. To
date, we have not received a response from DLNR-HPD.
Condition P: Annual Progress Reports are due on or before the anniversary date of the
rezoning ordinance (July 2, 1998).
Thank you for your attention to this matter. We look forward to the submittal of your
next annual progress report on or before July 10, 2002. In the meantime, please feel free
