Re: Mariorie B. Bachiller, et al., v. County of Hawaii, et al., Civil No. 00-1-0175
On November 7, 2001, the Hawaii County Council took a vote on our recommendation
for the above-referenced case which resulted in a tie vote. Rule 11, paragraph 10. (b), of the
Rules of Procedure of the Council of the County of Hawaii, provides, in relevant part, that "[i]n
the case of a tie on any matter considered by the Council, the matter shall be placed on the
agenda at the next Council meeting."
In accordance with Rule 11, we ask that this case be placed on the agenda for the next
Council meeting.
Pursuant to Section 92-5(a)(4), Hawaii Revised Statutes, as amended, we request
attorney-client confidential discussion in executive session to consult with the County Council on
questions and issues pertaining to its powers, duties, privileges, immunities and liabilities
regarding the potential resolution of the above-entitled matter.
