Arakaki and Members of the County Council County of Hawaii Milo, HI 96720 Dear Chairman Arakaki and Council Members: In 1976, Ordinance 201 was adopted by the County Council requiring that an area be set aside for park and recreational purposes as part of the overall development of Sunrise Ridge Subdivision in Hilo. The parcel of TMK: (3)2-3- 050-072-0000 was filed as a "private park" with both the Land Court and the Bureau of Conveyances in 1995. The owner of this parcel is listed as Sunrise Ridge Phase II and listed taxpayer of the parcel as Chiaki Matsuo, who passed away several years ago. A search of the tax records by the Department reveals that after the 1995 tax assessment was sent, no party sought to dispute, adjust, or otherwise appeal under Section 19-91, Hawaii County Code. The parcel was assessed as an undeveloped parcel within a residential subdivision. It was not until September 1999 that the Real Property Tax Division was notified of the 1995 conveyance and recordation. Upon the Division being so notified, the assessment for the upcoming tax year was adjusted to the minimum tax of $25. Real property taxes, penalties, and interest on this parcel have not been paid since 1995. The purpose of this resolution is to authorize the County Director of Finance to compromise $8,691.93 in taxes, penalties, and interest owed on this parcel to an amount equivalent to the minimum tax rate that should have been applied for the tax years 1996 to 2000. At the minimum rate, the outstanding delinquency for the tax years 1996 to 2000 would be $125.00 in taxes, $12.50 in penalties, and $48.15 in interest, for a total of $185.65.
