Dill No. 225, Draft 3
Attached for your transmittal to the Public Works and Intergovernmental Relations
Committee is Dill No. 225, Draft 3. As discussed at the committee meeting held October
23, 2001, this bill was deferred for a period of thirty days to allow members of the
council to work with the Public Works Department on specific amendments. To date, we
have received and incorporated amendments to the following sections:
1. Section 22-2.5. Commercial use of county streets.
2. Section 22-3.2. Public utilities exemption.
3. Section 22-4.4. (c) (d) Construction permits; conditions.
4. Section 22-4.6. (a) Maintenance of sidewalk area.
The language and details of these amendments can be found in the attached chart and
communications.
Also, at this meeting there was a request for a ramseyer version of changes between Draft
1 and 2. Unfortunately, because the Public Works Department utilizes a different word
program then we do, when Draft 2 was transmitted much of the document and formatting
was either lost or corrupted. When we reproduced the document, the amendments from

public hearings, etc. were incorporated. As a result, the final document created was Draft
2 and a detailed table explaining the amendments was prepared and transmitted to
supplement the review. In order to ramseyer the changes between Draft 1 and 2, Draft 1
would need to be reproduced. This would be a very time consuming process that is not
required. While a ramseyer version maybe helpful and/or necessary in some instances,
the County of I-lawai`i, Legislative Drafting Manual does not require it when an entire
chapter, like this, of the county code is repealed. This being the case, we have compiled
and attached a chart entitled "Major Revisions" that details any significant amendments
that were made between drafts. We are confident this chart will assist members in
tracking and understanding any amendments.

Chapter 22, County Streets
I have two comments on the above Bi11225, Draft 2, and they are as follows:
1) Unless all the roads or streets have names, the Department of Public Works can only assign
a number based on the location of the driveway/structures on the property. The number
alone may not be useful to the County emergency response vehicle that needs any address
(Page 18, Article 5, Division 1, Street Names, and Division 2, Building Numbering).
2) The ordinance should require that the property owner is responsible to get an address from
the County Building Division. The County should not be responsible to contact all
property owners to assign an address (Page 19, Section 22-5.6, Buildings to be numbered;
duties of the property owner and Section 22-5.7, assignment of building numbers.

SUBJECT: DRAFT 2 BILL 225 TO AMEND CIIAPTER 22 -STREETS 8~ SIDEWALI£S
This is to inform you that a meeting was held on November 1, 2001 with Council Person Leithead-Todd,
Barbara Hashimoto, Nancy Crawford, Dennis Lee and myself to discuss commercial use of County
sidewalks. Based on this meeting, it was decided that a separate ordinance under Chapter 2 would be
drafted that would establish a permit process for commercial uses. Consequently, no significant changes
to the present version of Bi11225 will be necessary. However, Section 22-2.5 should be revised to read
as follows:
Except as permitted by Chalater 2 of the Ilavvai'i County Code ,
no person shall use any portion of a county street for the purpose of displaying, vending, hawking,
selling, renting or leasing any goods, wares, food, merchandise or other kinds of property.
