Your Committee on Public Works and [ntergovernmental Relations, to which was referred Communication No. 403 and
attached Resolution No. 141-0 l ,reports as follows:
Communication No. 403 dated October 19, 2001 is from Ivan Torigoe, Deputy Corporation Counsel, transmitting for
Council's review and consideration Resolution No. 141-O1, which authorizes acceptance of a 5-foot future road widening
section and drainage improvements from First Hawaiian Bank, trustee of the William Brilhante Self-Directed IRA
situated at Waiakea, District of South Hilo and specifically identified as TMK: (3)2-2-035:091(portion).
Resolution No. 141-O1 states that the First Hawaiian Bank is the Trustee of the William V. Brilhante Seif-Directed IRA
who is the owner of a 5-foot future road widening section located in Waiakea, South Hilo, Hawaii. The resolution also
states that this dedication is a condition of an agreement dated February 16, 1995 and Ordinance No. 97-147, Condition F,
which required that upon completion of subdivision improvements, the Brilhante Self-Directed trust provide and dedicate
to the County and at no cost to the County, the said 5-foot road widening section. Exhibit "A", a dedication deed and a
map further delineating the parcel, are also attached to the resolution.
In discussion, members of the committee complimented the Office of the Corporation Counsel on the thoroughness of this
resolution. In addition, Mr. Torigoe also explained that using a quitclaim deed instead of standard warranty deed for this
dedication was a requirement of the February 16, 1995 agreement.
Your Committee on Public Works and Intergovernmental Relations is in accordance with the purpose and intent of
Resolution No. 141-0 l and recommends its adoption.
