Your Committee on Finance, to which was referred Resolution No. 133-01, reports as follows:
Resolution No. 133-01, transmitted by Director of Finance William Takaba, via Communication
No. 369, dated October 1, 2001, authorizing the Director of Finance to negotiate a lease of real
property at O`okala County Gym and Park site to the Hamakua Diversified Agricultural
Association, d.b.a. the O`okala Community Center and Plantation Marketplace.
The County of Hawaii is the owner of that certain parcel of land situated at O`okala County
Gym and Park, identified as TMK: (3) 3-9-01-11, and located in North Hilo, Hawaii.
The Hamakua Diversified Agricultural Association, d.b.a. the O`okala Community Center and
Plantation Marketplace, anon-profit organization, desires to lease the aforementioned parcel for
the development of amulti-purpose center, that will include a community center, post office, and
multi-use production facility for farmers, artists, crafts people, and other producers of local
products. The facility is intended to assist displaced sugar workers and low-income community
residents to be self-sufficient through self-employment.
Pursuant to Section 2-120, Hawaii County Code, the Council of the County of Hawaii may, by
resolution, approved by a majority of its members, direct the finance director to negotiate the
lease of real property to non-profit organizations, at such rentals and on such terms and
conditions as deemed proper.
Also, pursuant to Section 2-120, Hawaii County Code, such lease of real property to non-profit
organizations may be made without the notice or appraisal as required in Chapter 2, Article 19.

Some members of Your Committee were concerned with a few sections of the lease agreement
and requested that the Department of Parks and Recreation provide an amended copy of the lease
agreement prior to the next Council meeting.
Your Committee on Finance is in accord with the purpose and intent of Resolution No. 133-01
and recommends its adoption.
