Your Committee on Planning, to which was referred Bill No. 115, transmitted jointly with
Bill No. 116 by Mayor Harry Kim per Communication No. 368, dated September 27, 2001,
regarding the State Land Use Boundary Amendment request by Jacinth anal Yv®nne I)eLuz, at
Ouli, Waimea, South Kohala, Hawaii, TMK: 6-2-05: 18, reports as follows:
Bill No. 115 amends the State Land Use Boundaries Map, H-14, by changing the district
classification for approximately 4.294 acres of land from an Agricultural to a Rural zoned
district. This is the first request for a boundary amendment or change of zone in the Waimea
Landmark Subdivision.
The irregular shaped subject property, owned in fee by the applicants, is located in the Waimea
Landmark Estates on the north side of Kawaihae Road and across of the Anekona Estates
Subdivision. It is one of the origina123 lots created in the Waimea Landmark Estates-Unit I,
which secured final subdivision approval on September 14, 1976. Waimea Landmark
Estates-Unit I-A was approved on December 1, 1981, creating an additional six lots. Planning
Department records indicate Ohana Dwelling Permits were approved for 13 lots and Real
Property Tax records indicate five lots have Condominium Property Regimes (CPR's).
The General Plan Land Use Pattern Allocation Guide (LUPAG) Map designation is Extensive
Agricultural, which allows uses for pasturage and range lands. The property is not situated
within the Special Management Area, as it lies approximately six miles east of the nearest
coastline.
Surrounding lands to the east and west of the subject property are 3-acre parcels which are zoned
A-3a. Lands immediately to the north are large acreage's zoned A-40 owned by the Queen
Emma Foundation and the State of Hawaii. Across the highway are the 26-lot Kanehoa
Subdivision, the 36-lot Anekona Subdivision, and the 10-lot Kamuela Plantations Subdivision.
These subdivisions include mixed residential uses, vacant lands, and few residential/agricultural
uses. There are approximately 28 lots within the Anekona and Kanehoa Subdivisions, which
have utilized the Condominium Property Regime concept. To the west of the Anekona and
Kanehoa Subdivisions are the 33-unit Ouli Ekahi affordable rental housing project and the 40-lot
Ouli Mutual Self Heip Housing subdivision which are classified under the State Land Use as
Urban. The Hale Wailani property is adjacent and west of the Anekona Estates Subdivision and
the housing projects. It is currently zoned A-la and the developer proposes a 49-lot subdivision
with minimum two-acre lots.

Committee Member Julie Jacobson explained that to be consistent with her stand on the
preservation of agricultural lands, she would be voting against this measure.
Your Committee did not entertain further discussion on this measure.
Your Committee concurs with the Planning Commission and the Planning Director for
recommending a favorable consideration for the State Land Use Boundary Amendment request.
Your Committee on Planning is in accord with the intent and purpose of Bill No. l 15, and
recommends it pass first reading.
