Your Committee on Planning, to which was referred Bill No. 1 16, transmitted jointly with Bill No. 1 15 by
Mayor Harry Kim per Communication No. 368, dated September 27, 2001, regarding the Change of Zone
request by Jacassth and Yvonne DeLuz, at Ouli, Waimea, South Kohala, Hawaii, TMK: 6-2-05: 18,
reports as follows:
Bill No. l 16 amends Section 25-8-7 (North and South Kohala Districts Zone Map), Article 8, Chapter 25
(Zoning Code) of the Hawaii County Code, by changing the district classification for approximately 4.294
acres of land from an Agricultural (A-3a) to a Residential and Agricultural (RA-2a) zoned district.
The irregular shaped subject property, owned in fee by the applicants, is located in the Waimea Landmark
Estates on the north side of Kawaihae Road and across of the Anekona Estates Subdivision. [t is one of
the original 23 lots created in the ~~6raimea Landmark Estates-Unit 1, which secured final subdivision
approval on September 14, 1976. Waimea Landmark Estates-U-nit [-A was approved on December 1,
1981, creating an additional six lots. Planning Department records indicate Ohana Dwelling Permits were
approved for 13 lots and Real Property Tax records indicate five lots have Condominium Property
Regimes (CPR's).
The applicants propose to subdivide the property into two lots, each with minimum of approximately two
acres in size. The applicants have constructed a single family dwelling where they reside and in±end to
construct a second farm dwelling on the property after the new zoning designation is secured. The second
farm dwelling vas approved by the Planning Director in 1999. The existing access off Kawaihae Road
will accommodate the two proposed lots.
The General Plan Land Use Pattern Allocation Guide (LUPAG) Map designation is Extensive
Agricultural, which allows uses for pasturage and range lands. The property is not situated within the
Special Management Area, as it lies approximately six miles east of the nearest coastline.
Surrounding lands to the east and west of the subject property are 3-acre parcels which are zoned A-3a.
Lands immediately to the north are large acreage's zoned A-40 owned by the Queen Emma Foundation
and the State of Hawaii. Across the highway are the 26-lot Kanehoa Subdivision, the 36-lot Anekona
Subdivision, and the 10-lot Kamuela Plantations Subdivision. These subdivisions include mixed
residential uses, vacant lands, and fe~br residential/agricultural uses. There are approximately 28 lots within
the Anekona and Kanehoa Subdivisions, which have utilized the Condominium Property Regime concept.
To the west of the Anekona and Kanehoa Subdivisions are the 33-unit Ouli Ekahi affordable rental
housing project and the 40-lot Ouli Mutual Self Help Housing Subdivision which are classified under the
State Land Use as Urban. The Hale Wailani property is adjacent and west of the Anekona Estates
Subdivision and the housing projects. It is currently zoned A-I a and the developer proposes a 49-lot
subdivision with minimum two-acre lots.
The ALISH classifies the property and surrounding area as '`Unclassified". The Land Study Bureau's
Detailed Land Classification System classifies the soils as "E" or Very Poor. The U.S. Soil Survey
classifies the soils as Puu Pa, an extremely stony very fine sandy loam with moderately rapid permeability,
medium runoff and moderate erosion hazard. These soils are used for pasture.
The properly is located within Zone "X", an area determined to be outside the 500-year flood plain.

According to the applicant's environmental report, there are no known rare, threatened or endangered plant
or animal species, and because the property was previously grazed by cattle and extensively graded for
development, there are no archaeological, cultural or historic sites located on the property. According to
the applicant, there are no valued cultural, historical or native resources nor has any traditional and
customary native 1-Iawaiian rights been practiced in the area.
The primary access for both lots will be a shared driveway from Kawaihae Road, a State Department of
Transportation road with an approximately 29-foot wide pavement with paved shoulders within a 60-foot
right-of--way.
The Department of Water Supply states that there are presently two 5/8-inch meters on the property.
According to the Department of Health, because the property is situated in a Critical Wastewater Disposal
Area and there is no municipal sewer system in the area, the applicant would be required to install a septic
tank system to dispose of wastewater.
Underground electrical and telephone services are available to the property. The nearest Police and Fire
facilities are located in Waimea., approximately 7 miles east of the property.
The Waimea Park and Anuenue Playground are located approximately 6 miles east of the property.
Spencer Beach Park is located approximately 6 miles to the west.
Bill No. 1 16, Draft 2, which included housekeeping amendments to clarify the language in Conditions B,
D, E, F, G, 1-l, and J was circulated and approved by Your Committee.
Greg Mooers, representative for the applicant, explained that the Planning Commissioners wanted to
clarify that the applicant would only pay for improvements which directly affect their property, so he
requested that Condition G reflect that. Your Committee then further amended Condition G by inserting
``which directly affect their property°' at the end of the sentence.
Committee Member Julie Jacobson explained that to be consistent with her stand on the preservation of
agricultural lands, she would be voting against this measure.
Your Committee did not entertain further discussion on this measure.
Your Committee concurs with the Planning Commission and the Planning Director for recommending a
favorable consideration for the Change of Zone request.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 1 16, Draft 2, as amended
to Bill No. 1 16, Draft 3, and recommends it pass first reading.
