November 16, 2001 TO: Executive Committee Members FROM: Jon Yoshimura, Presi RE: HSAC Resolution Request from Peter Carlisle Enclosed is a legislative proposal, originating from City Prosecutor Peter Carlisle, for inclusion in the 2002 HSAC packet. This proposal would amend the Hawaii Constitution to allow direct filing of felony charges and make implementing amendments to the Hawaii Revised Statues. As per our discussion at the November 9, 2001 HSAC Executive Committee Meeting I wanted to bring this item to your attention. Resolution 01-326 was discussed at the City & County of Honolulu Policy Committee on November 14, 2001, and was passed out of the committee for full Council approval. I~SOI~UT~14N (5) If satisfied there is probable cause, the judge signs off on the information and the case is ready for trial; and WHEREAS, the direct file method requires amendment of the Hawaii Constitution to authorize such use; and WHEREAS, approval by all the counties i5 required to include a legislative proposal in the HSAC legislative package; now, therefore, BE IT RESOLti7ED by the Council of the City and County of Honolulu that it approves for inclusion in the 2002 Hawaii State P.s~~~^~_a~ion of Counties` Legislative Pa~~::~;ge: (1) a r_.roposal. to amend the~IHawaii Constitution to permit prosecutors and the attorney general to initiate felony charges by filing a written informatioln signed by the prosecutor or the attorney general setting forth the charge in accordance with procedures and conditions, to be provided by the state l gisla*~ure and (2) a proposal to make implementing amendments to ttiie Hawaii Revised Statutes s~ould ~iie constitutional amendment be ratified; and i BE ITI~FURTHI;R RESOLVED that the proposals are attached as Exhibits A~,and B; and ~I I~~~ I I -2.-
