Monday, I became aware of the proposed Resolution 150-01, and did a web search to
obtain SB 99b anal SB 997. I-€ow Weeny folks have the facility to do this? I-Iow many folks
here know the contents of Resolution 150-01 ?
SB 996 permits the prosecutor and the attorney general to initiate felony charges. SB 997
outlines what will substitute for the grand jury.
I have read SB 997 several times. My guess is that the authors did not provide sufficient
checks and balances to obviate the grand jury system.
I believe that the due process provided by preliminary hearings and grand jury
proceedings is vital to our system of justice.
These steps are- needed to prevent abuses by a pr®secutor.
I respectfully request a no vote on Resolution 150-01: to do otherwise would send the
-~~ong signal to the Senate.

I~enry Schley Ervay, one of my most colorful relatives, enlisted in the Confederate Army
in 1163. After the war, he embarked on a livestock and real estate business in Texas. IIe
~,~ras elected Mayor of Dallas. I-£owever, Governor Davis decided that Mr. Ervay was not
:;uf~ciently loyal and had him. thrown on jail. He served a short time and was freed to
Serve as Mayor ~,nd Alderman for 10 years.
Since then. we have rraade legal progress in avoiding this kind of discriynination and
abuse. SB 996 dnd SB 997 are a step backward! ! !
