Your Committee on Planning, to which was referred Bill No. 130, transmitted jointly with Bill No. 129 by
Acting Mayor Dixie Kaetsu per Communication No. 412, dated October 30, 2001, regarding the Change
of Zone request by ;[henry Clinton ~ Sandie II. Williams, at Ouli, Waimea, South Kohala, Hawaii,
TMK: 6-2-1 1:15, reports as follows:
Bill No. 130 amends Section 25-8-7 (North and South Kohala Districts Zone Map), Article 8, Chapter 25
(Zoning Code) of the Hawaii County Code, by changing the district classification for approximately 5.453
acres of land from an Agricultural (A-Sa) to a Residential and Agricultural (RA-2a) zoned district.
The rectangular shaped subject property, owned in fee by Henry Clinton and Sandie H. Williams, Brian T.
Kerley Management Trust, and Marsha L. Kerley Trustee, is located in the Anekona Estates Subdivision
and bordered by Kanehoa Street and Keanuiomano Stream, about three eighths of a mile south from the
Kawaihae Road. It is one of the original 36 lots created in the Anekona Estates on October 23, 1990.
There is a 70-foot wide drainage easement along the rear boundary within Keanuiomano Stream. There
are two existing dwellings on the property, one near the front portion and one toward the rear portion of the
parcel. The applicants propose to subdivide the property into two lots to eliminate the present
Condominium Property Regime (CPR) ownership. The two lots will consist of 2.10 acres and 3.353 acres
respectively with one dwelling each.
The State Land Use designation is Agricultural. The General Plan Land Use Pattern Allocation Guide
(LUPAG) Map is designated as Extensive Agricultural, which allows uses for pasturage and range lands.
When the Zoning Code was adopted in 1967, the property and surrounding areas were designated as
Unplanned, referring to areas where sufficient studies were not conducted to determine specific district
classification and permitted uses relating to agriculture. When the amended Zoning Code was adopted on
December 7, 1996, all Unplanned zoned districts were redesignated as Agricultural-5 acres (A-Sa). With
the new proposed State Land Use (SLU) Rural District and Residential and Agricultural (RA-2a) zoning,
Ghana dwellings are a permitted use.
The subject property, located approximately six miles east from the nearest coastline, is not situated within
the Special Management Area of the County.
Adjacent lands to the north and east of the property are parcels in the SLU Rural District and County
RA-2a zoning designation. Other lands adjacent to the subject property are A-Sa parcels within the State
Agricultural District, which include residential uses and vacant lands.
Other surrounding lands include the 26-lot Kanehoa Subdivision, the 10-lot Kamuela Plantations
Subdivision, and the 26-lot Waimea Landmark Estates Subdivision. These subdivisions include mixed
residential uses, vacant lands and very few residential/agricultural uses. There are approximately 28
Condominium Property Regimes within the Anekona and Kanehoa Subdivisions. The 33-unit affordable
rental housing project Ouli Ekahi, and the 40-lot Ouli Mutual Self Help Housing project are located to the
west of Anekona Estates and are designated as SLU Urban. The Hale Wailani property is adjacent and to
the west of the Anekona Estates Subdivision.

The Agricultural Lands of Importance to the State of Hawaii (ALISH) System designation is
"Unclassified". The Land Study Bureau classifies the soils within the property and surrounding area as
"E" or Very Poor. The US Soil Survey classifies the soils as Puu Pa extremely stony very fine sandy loam
with moderately rapid permeability, medium runoff, and moderate erosion hazard, which are used for
pasture.
The property is located within Zone X, an area determined to be outside the 500-year flood plain.
The applicants' environmental report states there are no native fauna or known or recorded rare or
endangered animal or plant life in the area. Because the property was previously grazed by cattle and
extensively graded for development, there are no known archaeological, cultural or historic sites located on
the property; however, the condition to notify the Department of Land and Natural Resources-Historic
Preservation Division should any sites be uncovered is included in this measure.
Access to the subject property is from Kawaihae Road via Anekona Street or Kanehoa Street. There are
two existing access driveways on the property.
Water is provided to the subject property by an existing 6-inch water line, and presently, there are two
5/8-inch meters on the property.
Because the property lies in the Critical Wastewater Disposal Area and there is no municipal sewer system
in the area, the applicants would be required to dispose the wastewater into a septic tank system.
All utilities and services are available to the property.
Your Committee did not entertain further discussion on this measure.
Your Committee concurs with the Planning Commission and the Planning Director for recommending a
favorable consideration for the Change of Zone request.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 130, and recommends it
pass first reading.
