Subject: Request for Administrative Time Extension Tax Map Key: 2-6-12: por 4; 2-6-13: por 7 This is to acknowledge receipt by our office on November 6, 2001 of a request to grant an administrative time extension pursuant to Condition N of the above referenced ordinance. The reasons given for this request indicate that the global economic malaise of recent years has made it impossible to complete the proposed project within the original time constraints. Since non-performance is the result of unforeseen conditions and the granting of a time extension is not contrary to the General Plan, the Zoning Code, or the original reasons for granting the rezoning, the Planning Director hereby grants a five (5) year administrative time extension. The applicant shall secure Final Subdivision Approval in compliance with Condition D of Change of Zone Ordinance No. 96-152 by December 5, 2006. Please also note that Condition I of the ordinance, which identifies the applicable fair share contributions for mitigating regional impacts from the development, includes the following requirement: "The fair share contribution described above shall be adjusted annually beginning three years after the effective date of the change of zone, based on the percentage change in the Honolulu Consumer Price Index (HCPI)." f~~, ~€l~ f. ~fl: Rif. l:""~~~~~.., ~ ~ E Mr. Sidney Fuke Planning Consultant Page 2 December 14, 2001 Since an administrative time extension does not alter the effective date of the ordinance, that date remains December 5, 1996. No. 96 151) and subsequently rezoned into the Single Family Residential (RS-1 S) district (Ord. No. 96 152) on December 5, 1996. The rezoning was approved subject to a number of conditions, one (Condition D) of which required the consummation of the subdivision of the property within five years of the effective date of the rezoning ordinance (December 5, 2001). Due to organizational changes of the applicant's parent company as well as the global economic malaise the past few years, the project has not been able to proceed as expeditiously as originally envisioned. As such, and pursuant to Condition N, the applicant is hereby requesting an additional five (5) years to consummate the subdivision. As you consider this request, please note that: 1. this request was a result of unforeseen circumstances as noted above; 2. the General Plan LUPAG map of this area has not been changed or contemplated for change in the current General Plan update program; 3. the land use and planning rationale for approval of the initial request has not changed; and 4. this request is for a period no longer than the original 5-year request.
