Moore Planning SUBJECT: Uohara Change of Zone-Bill No. 139, Draft 2 This is to follow up with respect to the proposed Condition E of Bill No. 139, Draft 2, related to prohibition of landscaping. This condition presently reads as follows: Restrictive covenants in the deeds of all the proposed lots within the subject property shall prohibit any landscaping which negatively impacts the drainage systems. (For example, grave placed over plastic washing into the drywells, drainage channels, etc.) The proposed language was very restrictive in that it prohibits "ANY" landscaping which negatively impacts drainage systems. There is no definition of landscaping (although examples are provided) or drainage systems. Accordingly, this language is so broad, it may be impossible to do anything on the land and not potentially violate this covenant. While Dr. Uohara is generally supportive of the concept to limit downstream impacts from gravel run-off, there are concerns with the above language. Accordingly, we offer the following for your consideration: Restrictive covenants in the deeds of all lots within the subject property shall prohibit the placement of gravel or other similar material. on plastic or other impervious surfaces in areas within fifteen (15) feet of any street(s) or drainage channel(s) or other drainage improvement(s). The purpose of this condition is to minimize the potential for gravel or other similar material to wash into street or drainage improvements during storm events. This proposed language directly addresses the concerns with respect to the placement of gravel and other material on plastic surfaces and runoff of material onto streets or blocking drainage channels. I have tried to make it clear as to what can occur and where it is prohibited. I look forward to working with you to finalize an amendment to this condition so the rezoning can proceed.
