Your Committee on Public Works and Intergovernmental Relations, to which was referred Communication No.
361 and attached Bill No. 112 reports as follows:
The purpose of Bill No. 1 12 is to amend Chapter 2, Article 5 of the Hawaii County Code 1983 (1995 Edition),
relating to the duties and qualifications of the Fire Chief and the establishment of a Fire Commission.
Communication No. 361 dated September 24, 2001 is from the Honorable Mayor Harry Kim transmitting
Bill No. 112 for the Council's review and consideration. In his letter, Mayor Kim states that this amendment will
bring the code into conformance with the Charter of the County of Hawaii as amended by the voters in November
2000.
As a result of discussion, the committee voted to amend these sections of the bill with the following:
1. Section 2-13 was phrased to read as:
"The fire chief shall be appointed by the, fire commission and may be removed by the fire commission at
its sole discretion. Any motion for removal of the fire chief must contain a statement of reasons and, the
fire chief must be allowed to respond to the statement of reasons before being removed. The fare chief
shall have had a minimum of
frve years of training and experience in frre control, including at least three
years of experience in a responsible administrative capacity."
Z. Section 2-14 was relocated to be included as item number six under Section 2-15 and phrased to read:
"The fire chief shall appoint members of the department under established personnel rules and
regulations, and statutes. "
3. Section 2-15, taking into account the amendment to Section 2-14 is to be appropriately renumbered.
Your Committee is in accord with the purpose and intent of Bill No. 1 12, as amended to Draft 2, and recommends
that it pass first reading.
