Your Committee on Public Works and Intergovernmental Relations, to which was referred
Communication No. 351 and attached Resolution No. 130-01, reports as follows:
Communication No. 351 dated September 13, 2001, is from William Takaba, Director of Finance, transmitting for
Council's review and consideration Resolution No. 130-O1, which authorizes a grant of easement for a telecommunication
conduit between Prince Jonah Kuhio Kalaniana`ole Elementary and Intermediate Schools, at Ka`apoko, District of South
Hilo, specifically identified as Tax Map Key (3) 2-7-25:04 and (3) 2-7-22:02.
Resolution No. 130-O1 states that the County of Hawaii is the owner of the Old Government Main Road located in South
Hilo and fronting Prince Jonah Kuhio Kalaniana`ole Elementary and Intermediate schools. The resolution further states
that the State of Hawaii, Department of Education and Department of Accounting and General Services has requested
this easement to the County's property to construct and repair lines and conduits that are necessary for telecommunication
transmissions. Exhibit A, a map further delineating the parcel, is also attached to the resolution.
In discussion, members of the Committee questioned the applicability of citing Hawaii County Code, Section 2-1 1 1, in
the resolution. Councilmember Yagong urged Committee members to approve Resolution No. 130-O1 and assured them
that he S.vould secure an opinion from the Office of the Corporation Counsel, regarding the pertinence of referencing
Section 2-1 I 1 in these types of easement situations.
Your Committee on Public Works and Intergovernmental Relations is in accord with the purpose and intent of Resolution
No. 130-01 and recommends its adoption.
