HomeMy WebLinkAboutCOM 0436.001 2000-2002 Norman Olesen I~ 2 Box 4750, Pahoa, ~I 96778 808-965-9406 To: Finance Committee January 8, 2002 County of I-Iawaii From: Norman Olesen Subj: Testimony pertaining to Comm. 436 (Bi11145), Comm. 437 (Bill 146), and Comm. 438 (Bill 147) These three projects to provide ADA compliance with Federal regulations, although worthy in there own right, are not scheduled for work until Schedule 1 projects (see attachment "A") have been completed in accordance with the Self-Evaluation & Transition Plan for Accessibility to Public Facilities adapted by the County Council in June 2000 and as required by the Consent Decree and Order filed in Russell et al v. County of I~awaii in USDC Civil No. 97- 01102SPK dated June 4, 1998. Adding funding for these projects: • dilutes the ability to provide adequate funding for existing ~~CEt'V~ ~ projects in Schedule 1.(Attachment "B" and "C") • Violates the Consent Decree in that any change to the '0~9~""-`-_-~-'i~;~ By-_ priority listing approved by the County Council and the Gounty Councal plaintiff requires the consent of the plaintiff as stipulated in the Consent Decree. It should be of interest to the County Council members that no construction projects were issued in the year 2001. There are only 18 months left to complete somewhere between $ 4 and $ 6 million dollars of construction. There are insufficient funds appropriated to meet this demand. On January 6 the newspaper announced two projects which are out for bid with an estimated cost of $1 million. Attached (Exhibit "D") is also the log from the Disability & Communication access Board (DCAB) regarding plans that have been reviewed and finalized. Council members should be aware of which projects are ready to go out for bid but are not part of the latest Parks ~i Recreation schedule (Exhibit "C"). If these attachments are reviewed carefully you will note inconsistencies in costs and it raises the question why DCAB's final approval of drawings on certain projects have not gone out for bid . As an example Onekahakaha Beach Park drawings were finalized by DCAB in October 1999 as a CDBG project and is still not out for bid. In light of the above I would recommend the requested funding on these three bids be deferred until a full audit with timetables be conducted to determine what funding is available for existing ADA compliance projects. Although the trail to Lalakea Pond is not accessible to disabled persons in wheelchairs, it may be accessible to persons with other disabilities who would still qualify for accessible parking. 3) I have been to Richardson's with Ms. Dey. We are following the ADA Transition Plan and ADA improvements at Richardson's are not part of the phase we are working on. 4) The ADA Transition Plan is progressing on schedule. We are in the design phase of Schedule 1. We have sent three projects to Public Works to be advertised: Shipman Park Improvements, Waiakeawaena Playground Improvements and Pahala Community Center Improvements. We are circulating four projects for final approval: Aunty Sally's Luau Hale, Konawaena Pool Improvements, Laupahoehoe Point Park Improvements and Kailua Playground Improvements. The rest are in varying stages of design. 5) Regarding Onekahakaha which is first on the list, we are awaiting the contractor's final plans, and have been for about 6 months.
