WHEREAS, Dale Anuenue (a subsidiary of Life Care Centers of America based in Cleveland, Tennessee) is a long term care provider located in Hilo; and WHEREAS, the ILWU Local 142 was elected during a recognition election in October 2000 to represent the workers at Hale Anuenue; and WHEREAS, the ILWU Local 142 and Hale Anuenue have been negotiating since February 2001; WHEREAS, the ILWU Local 142 and Hale Anuenue have reached an impasse on union security language in their negotiations, which has reached near strike crisis; and WHEREAS, if left unresolved, this dispute will inevitably lead to a loss of qualified employees that will have dire consequences to all concerned — residents and their families, present employees and their families, Hale Anuenue, and the entire community; and WHEREAS, quality care for the residents at Hale Anuenue, many of them infirm senior citizens, should not be compromised because of this labor dispute; and WHEREAS, even the most difficult of issues can be resolved by reaching mutually agreeable terms when parties to a dispute sit down and negotiate in good faith. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF I-HAWAI`I that it supports the continuation of good faith negotiations between ILWU Local 142 and the Male Anuenue administration to resolve outstanding issues to insure that the quality of care for residents at Hale Anuenue remains at the highest possible level. Yamamoto Executive Director HALE ANUENUE RE: Employee Strike I am strongly in support of your improving the morale of the present Hale Anuenue workers. They are maintaining the level of care (CNAs), even through the so-called "prolonged negotiations" and near -strike crisis. But, when, and if they strike, we can imagine the chaos and the hardships residents and families will face, not to mention striking families and Hale Anuenue. We honestly cannot feel content or comfortable in the hands of the massive group of totally new outside workers. Citing one example: we feel that it takes a long time for a new worker -to really get to know about a resident's care and specific needs. Hardship for resident, period; worry for the families, period. _ I respectfully ask for further consideration in finalizing mutually -agreeable terms for your current employees so that a strike will be averted. A strike will be devastating to all concerned: residents and families; present employees and families; Hale Anuenue; and to the entire community! One more try, please. [Certified Nurses Aide] and was employed by Hale Anuenue Restorative Care Center from June until December of the year 2000. The work was hard and the pay was low but the rewards of providing the best possible care to the elderly residents was a reward in its self. I was a model employee I won an award for my dedication and then one evening, I was unfortunately involved in an incident with one of the residents and fell victim to "Company Policy." I was terminated and went to my Union Business Agent to try to get my termination overturned. The company took the stand that because there was no contract in place they were not obligated to recognize the grievance process of the Union. My co-workers Residents and their families as well as the professional staff did not feel that I should have been terminated. When I spoke to the Adult Protective Services Agent she to felt that the termination was harsh under the circumstances. The Health and Safety Services response was the same. This is why the workers need Union Security in there contract! There are government regulations that protect the residents in long term care facilities. There is a patients bill of rights. Who will protect the workers? This is one of the main reasons for voting in the I.L.W.U. at Hale Anuenue and since negotiations began in February 2001 until now there is still no contract. One of the few remaining issues is Union Security and until the company can agree to that there will be no contract. I urge you as members of the community to give your support to the hard working :and dedicated employee's of Hale Anuenue and help them to gain a fair and secure contract. I enjoyed working with the Residents at the facility but, was forced to seek employment elsewhere because of the low pay. I am now employed at North Hawaii Community Hospital and receive a significantly higher rate of pay, letter working conditions, and have a lower workload. I wish the best to my fellow employee's at Hale Anuenue in reaching a fair contract. We are the workers of Hale Anuenue, our Union, and supporters who want to assure that the quality of service that we provide at Hale Anuenue continues in the future. After ten months of negotiations, we were very close to winning a fair union contract. However, Hale Anuenue management almost forced a strike early in December. Replacement workers were brought in from Honolulu to do our jobs. After discussions with community members such as Mayor Harry Kim—and especially after seeing that the replacement workers could not provide your loved ones with the same quality of care, we could not find it in our hearts to strike. The fact is that we put your family members needs before our own because we truly care for the people that we provide for! The issue is not money. Hale Anuenue management is demanding language that will take away our strength as union members. We want to continue to give quality care to our residents. We also want to keep quality workers at Hale Anuenue and stop losing them to other facilities. A fair and secure Union contract will help us to do this. We would like to ask for your support in helping us to gain a secure contract.
