Bnclosed is a bill for an ordinance amending the Operating Budget by appropriating
$66,875 from the Cemetery Fund Balance to the Alae Cemetery Improvement OCE
account. The funds will be used to pay Dodo Mortuary, Inc. fora 12,600 foot parcel of land
which was deeded to the County in 1993.
In order to expedite this matter, the Department of Parks & Recreation would like to
request a waiver from the Finance committee and have this bill heard at the Council
meeting scheduled for January 24, 2002.
If there are any questions, please do not hesitate to call the Department of Parks and
Recreation.

SU6JI=CT: Payment for Dodo Mortuary 12,600 plot at Alae Cemetery
In an agreement signed April 5, 1993 between Mayor Stephen K. Yamashiro and Clifford Dodo,
Vice President of Dodo Mortuary, Dodo transferred 12,600 square feet of land at Alae Cemetery
to the County of Hawaii. The County was to have exchanged a future acquisition of equal size in
return for that transfer of land. If that transfer could not be made, Dodo was to be paid the fair
market value for the land.
In his letter of August 9, 2001, Mitchell Dodo asked Mayor Larry Kim to follow through on the
commitments of others. In his letter of August 28, 2001, Harry Kim asked me to negotiate a
resolution. Mike McCall of the County Real Property Tax Office and I met with members of the
Dodo Mortuary staff on September 6, 2001. Options were discussed. On October 15, 2001, I
memoed harry Kim with the options, with a recommendation that we buy out Dodo it we were
able. Managing Director Dixie Kaetsu asked me verbally to negotiate a figure for the purchase
and to pay for it with the Cemetery Fund.
~a We offered- $65,250, the value of the number of plots we were able to get out of the 12,600
square foot parcel.
a Dodo Mortuary countered with $75,000.
a We offered $66,875, which was splitting the difference between the value of the plots Dodo
thought we could put into the parcel (325 X $250 = $81,250) and the number of plots Mike
McCall thought Sve could put in the parcel (210 X $250 ~ $52,500).
a Mitchell Dodo accepted the second offer of $66,875 in his letter of December 10, 2001.
We asked Deputy Corp Counsel Craig Masuda if anything further was needed to effectuate the
land exchange. He said that the 1993 agreement between Yamashiro and Dodo already deeded
the Alae parcel to the County. '
Would you please, therefore, arrange for the appropriation to use the Cemetery Fund to pay
Dodo Mortuary, Inc. for the parcel?

Pursuant to Section 1(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter placed onto the next Council agenda for review. However, in the event this request is
denied, for whatever reason, l understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
