Subject: Resolution Number 168 02
The State of t~lawaii supports County of Hawaii Resolution 168 02 and urges your
favorable consideration, inasmuch as your action also will affect employees in the State
and other jurisdictions.
The Excluded Managerial Compensation Plans of all jurisdictions cover division chiefs
and other key managers in those jurisdictions. The Hawaii Revised Statutes currently
require that:
1. pay adjustments for this group be not less than and not later than those provided to
employees in the professional and scientific bargaining unit;
2. pay adjustments be uniform among all jurisdictions; and
3. the Chief Executives and legislative bodies of all jurisdictions approve funding of pay
increases.
The Conference of Personnel Directors, composed of the Human Resource ®irectors
from all jurisdictions, spent considerable time last summer crafting pay adjustments that
would meet these statutory requirements for the July 2, 2001, pay increases for this
group. Further, all jurisdictions, other than Hawaii County, have secured funding
approval from their respective legislative bodies for these pay increases. However, the
lack of action by Hawaii County now prevents all of the other jurisdictions from
implementing the pay increases for their EMCI' employees.
Section 89C-5, HRS, requires that funding be approved by all applicable legislative
bodies and uniform effective, dates for the pay increases. However, there is no
requirement that the actual payments be made on the same date.

The State appreciates the financial considerations that have played a part in the delays
in Hawaii County. However, this resolution provides the fiscally prudent alternative of
deferred payment by Hawaii County but also allows fibs other jurisdictions to implement
the pay increases for their ~10tIC~ employees.
s411 employees in all jurisdictions except those in the EMCf' have received their July 2,
2001 pay adjustment. iNe believe we must process our payments to our ~IVIC~
employees as soon as possible to avoid a loss of trust with this group and a potential
violation of Section 39C-2 (2) which requires adjustments which are not less than those
provided under collective bargaining to professional and scientific employees. 6~pproval
