Your Committee on Finance, to which was referred Resolution No. 153-01, reports as follows:
Resolution No. 153-O1, transmitted by Director of Finance William Takaba, via Communication No.
446, dated December 3, 2001, for the disposition of a house located at Ahalanui Park to Ho`oulu L~hui,
Inc., a Hawaii nonprofit corporation.
The County of Hawaii has acquired a parcel of land, known as Ahalanui Park, situated at Laepao`o-
Puua, Puna, Hawai `i, and designated as Tax Map Key: (3 )1-4-02:06.
The Ahalanui Park Master Plan calls for the removal of an existing house. On December 1, 2000, the
County entered into an agreement with Ho`oulu Lahui, Inc. donating this house to that corporation. The
removal and relocation cost of $15,000 will be provided from funds received from the Federal
Emergency Management Act (FEMA).
Section 2-120, Hawaii County Code, permits the Council by resolution to direct the Finance Director to
negotiate the disposal of real property to nonprofit agencies.
Also, Section 2-l 31, Hawaii County Code, authorizes the Director of Finance to dispose of County
equipment.
Members of Your Committee expressed concerns over the legality of the December l , 2000, donation
agz~cement as the administration had not been given authorization by the Council to commit funding and
to donate such property.
For informational purposes. Mr. Tyler voted kanalua then yes.
Your Committec on Finance is in accord with the purpose and intent of Resolution No. 153-O1 and
recommends its adoption.
