RE: Resolution 161-02, Draft 2
Disposition of Hamakaua Lands
This is to transmit Resolution 161-02, Draft 2, which was the result of the following amendments made at
the Council's meeting on January 24, 2002:
1. 8th WHEREAS clause: "WHEREAS, it is the desire of the County Council to either [dispose or
exchange] sell, lease or exchange these lands so that they may be more beneficially used."
2. 9th WHEREAS clause: "WHEREAS, Chapter 2, Article 19, Section 2-11(a)(1) and/or (3) of the
Hawaii County Code provides that the Council may, by resolution approved by a majority of its
members, direct the Director of Finance to dispose of real property in fee simple by lease, sale or to
exchange real property for private property; and"
3. 16th WHEREAS clause: "WHEREAS, in the short-term, and while [negotiations for land
exchange] arrangements and/or negotiations for land disposition are occurring, the County is
desirous of offering two-year pastoral leases on the Hamakua lands with month-to-month options
thereafter for the purpose of keeping weeds, grass and other vegetation under control; and"
4. 17th WHEREAS clause: "WHEREAS, if the short-term disposition is performed by negotiation, the
public interest demands it [because ofJ to reduce the potential fire hazard to the surrounding
community."
5. 1St BE IT RESOLVED clause: "NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL
OF THE COUNTY OF HAWAII, through its authority under Sections 2-111, 2-112, 2-114, and 2-
115, of the Hawaii County Code, that it approves of and directs the Finance Director or authorized
representative to proceed with the sale [of real property] by auction or [negotiations for a land
exchange] exchange by negotiation as long as the t~ublic interest demands it, on avalue-for-value
basis, of so much as may be necessary of the former Hamakua Sugar Company, Inc. lands now
under County ownership which are delineated
