HomeMy WebLinkAboutREP PC 060 01/23/2002 2000-2002 REPORT OF THE COMMITTEE ON PLANNING DATE: January 23, 2002 C-479 /Bill No. 156 PLACE: Councilroom TIME: 3:00 p.m. Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No. 156 transmitted jointly with Bill No. 155 by Mayor Harry Kim per Communication No. 479, dated January 9, 2002, regarding the change of zone request by Phil I)elrner~, at Ouli, South Kohala, Hawaii TMK: 6-2-11:8, reports as follows: Bill No. 156 amends Section 25-8-7 (North and South Kohala District Zone Map), Article 8, Chapter 25 (Zoning Code) of the Ilawaii County Code, by changing the district classification for approximately 5.006 acres of land from an Agricultural (A-Sa) to a Residential and Agricultural (RA-2a) zoned district. The rectangular shaped subject property, owned in fee by the applicant and Diane C. Delmer, is located in Anekona Estates Subdivision bordered by Kawaihae Road and Kanehoa Street. The property is currently vacant of any structures and agricultural activities. The applicant intends to subdivide the subject parcel into two 2-acre minimum sized lots, with no immediate plans to improve the parcels. The current State Land Use District classification is Agricultural, although the applicant has a joint application to amend it to Rural. The General Plan LUPAG map classification is Extensive Agricultural, which permits pasturage and range lands. The subject property, located approximately six miles from the nearest coastline, is not situated within the Special Management Area. On October 23, 1990, the 36-lot Anekona Estates Subdivision was created. Planning Department records indicate Ohana Dwelling permits were approved for 12 lots, and Real Property Tax records indicate there are 14 lots with Condominium Property Regimes. Surrounding properties are located within the State's Agricultural and Rural Districts and in the County's Agricultural (A-Sa and A-la) and Residential and Agricultural (RA-2a) zoned districts. The 26-lot Kanehoa Subdivision, located immediately to the east of Anekona Estates Subdivision has 16 lots with Ohana Dwelling permits, and 14 lots with Condominium Property Regimes. The l 0-lot Kamuela Plantations Subdivision is located further to the east; and the 26- lot Waimea Landmark Estates Subdivision is located across the Kawaihae Road and further to the northeast. These subdivisions include mixed residential uses, vacant lands, and very few residential/agricultural uses. The 33-unit Ouli Ekahi affordable rental housing project and the 40-lot Ouli Mutual Self Help Housing Subdivision project are located to the west of Anekona Estates and are designated as State Land Use Urban District. The Hale Wailani property, adjacent to and west of Anekona Estates Subdivision and the housing projects, is currently zoned A-1 a and the developer proposes a 49-lot 2-acre minimum sized subdivision. PC-60 PC- 60 -2- January 23, 2002 The property and surrounding area are "Unclassified" based on the ALISH system. The Land Study Bureau's classification of the soils is "E" or "Very Poor". The US Soil Survey classifies soils as Puu Pa, an extremely stony very fine sand loam with rapid permeability, medium runoff and moderate erosion hazard, which are used for pasture. The property is located within Zone X, an area determined to be outside the 500-year flood plain. According to the applicant's environmental report, there are no known or recorded rare or endangered animal or plant life in the area. Because the subject property was previously grazed by cattle and extensively graded for development, no archaeological, cultural or historic sites are known to be located on the property. The primary access for Anekona Estates from Kawaihae Road is via Anekona Street. The subject parcel has two 1-inch water laterals, and each of the meters shall front the proposed parcel they arc to serve. The Department of Health states that the property is situated within a Critical Wastewater Disposal Area, therefore, the applicant would be required to dispose wastewater into a septic tank system. All utilities and services are available to the property. Committee Member Julie Jacobson explained that to be consistent with her stand on the preservation of agricultural lands, she would be voting against this measure. Committee Member Curtis Tyler amended Condition D a bit further to include our now standard language to also include the prohibition of Condominium Property Regimes. Your Committee did not entertain further discussion on this measure. Your Committee concurs with the Planning Commission and the Planning Director for recommending a favorable consideration for the change of zone request. Your Committee on Planning is in accord with the intent and purpose of Bill No. 156, as amended to Bill No. 156, Draft 2, and recommends it pass first reading.
