Attached for your favorable consideration is proposed Bill No. 151, Draft 3 which includes the
following amendments:
1. Condition F. Inserts "and condominium property regimes".
2. Condition J. Inserts new language to prohibit access to any properties adjacent to
the existing Kaloko Mauka subdivision.
3. Renumbers the remaining conditions.
4. Condition O. Inserts "and/or in kind services approved by the Planning Director".
Also inserts into the third paragraph, "prepare studies and designs".
Due to the renumbering of the conditions, the fair share condition is now
referenced as Condition O instead of Condition N.
5. Condition P. Deletes "prepare a Traffic Impact Analysis Report (TIAR) for the
Mamalahoa Highway-Kaloko Drive intersection ,and".
Replaces the word "may" with "shall".
Deletes "and/or towards funds previously collected".
Inserts "If it exceeds the applicant's requirements under Condition O, the excess
shall be paid by funds previously collected by the County.
