Your Committee on Public Works and Intergovernmental Relations, to which was referred
Communication No. 501 reports as follows:
Communication No. 501, dated January 22, 2002, is from J. Curtis Tyler, [[I, Vice President, H'awai`i
State Association of Counties, submitting highlights of the HSAC Executive Committee meetings held on
December ] 0, 2001 and January 16, 2002, as well as, the Treasurer's Report for October, November and
December 2001. This communication also requests consideration of House Bill No. 1256 for inclusion
within the 2002 HSAC Legislative Package and reports the following items as approved and currently
part of the package:
1. Bill Relating to State and County Tort Liability - To extend tort liability to the State a.nd
Counties and their lifeguards for damages arising from the operation of public beach
parks.
2. Bill Relating to Publication of Notice - To exempt the counties from the publication of
notice requirements in Section 1-28.5, HRS, except for procurement code and health and
human services contracts.
3. Bill Relating to Limited Liability for Counties - To limit the counties' tort liability arising
from certain hazardous recreational activities on county-owned or -controlled propert'ses.
4. Bill Relating to Landowner's Liability - To extend the counties the limitation of liability
currently afforded to private landowners who make their land and water areas available to
the public for recreational purposes.
5. Bill Relating to Traffic Fines - To enable the respective counties to impose and collect
fines for violations of the statewide traffic code, in addition to the fines imposed by the
State under Chapter 291 C, HRS.
6. Bill Relating to Liquor License Fees - To designate a portion of liquor license fees for
funding of education, prevention, and treatment programs designed to address alcohol
abuse.
H.B. 1256 entitled "relating to solid waste", imposes new requirements and fees on beverage containers in
the State of Hawaii. It proposes that distributors of beverage containers register with the state and provide
for the redemption of such containers. This also establishes the beverage container deposit special fund
and other requirements for recycling facilities and redemption centers. The bill is attached to this report
in its entirety.

Councilmember Tyler explained that this item did not make the NSAC 2002 Legislative package cut-off
and that the Council of the City & County of Honolulu is currently reviewing it. Councilmembers, in
discussion, expressed support for the bill's concept, but questioned if other bills being considered during
this session of the legislature could be more effective.
Council Chair James Y. Arakaki expressed his concern that the bill would prove to be a burden on
business owners because it imposes additional fees and mandates that they function as redemption
centers. Chair Arakaki voted against the motion to include this measure in the legislative package.
Your Committee on Public Works and Intergovernmental Relations recommends the inclusion of Flousc
Bill 1256 in the Hawaii State Association of Counties 2002 Legislative Package.
