A RESOLUT-ION AUTHORIZING THE MAYOR TO NEGOTIATE AND EXECUTE AN
AGREEMENT WITH OCEANSIDE 1250, TO SATISFY CONDITION "M" OF
ORDINANCE NO. 97-36.
WHEREAS, Oceanside 1250 owns land in North Kona, Hawaii,
covered by tax map keys (3)8-1-4: portion of 3, (Property); and
WHEREAS, Condition "M" of Ordinance No. 97-36 states that
"The applicant shall establish a program for employee housing
which shall be submitted for the review and approval of the
Planning Director and Housing Agency together with the submittal
of plans for Plan Approval for the proposed lodge. The program
shall include provisions for on-site or off-site housing for the
employees of the lodge in an amount to be determined by a study
of surrounding housing opportunities and employee needs. The
program may also include consideration for other alternatives
such as rental housing subsidies or housing allowances. The
approval of the program shall be secured prior to the issuance
of a certificate of occupancy of the lodge within the subject
area."
WHEREAS, on January 18, 2000, as part of their Special
Management Area Use Permit, Oceanside 1250 submitted the
proposed housing plan for approval by the Planning Director; and
WHEREAS, the Hawaii County Housing Agency approved the
attached Housing Plan pursuant to Chapter 11, Section 11-5(d) of
the Hawaii County Code.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII that the Mayor is hereby authorized to negotiate and
execute an agreement with Oceanside 1250 to satisfy Condition
"M" of Ordinance 97-36.
BE IT FURTHER RESOLVED, that a copy of this resolution be
transmitted to the Office of Housing and Community Development,
the Planning Department and Oceanside 1250.

The I-iokuli`a Members' Lodge employee Housing Program (Program) consists of
the following basic points:
~ Oceanside 1250 (OC) will establish an Employee Housing Fund (Fund) to
provide housing loan subsidies and promote other housing -related
educational programs for the benefit of the Hokuli`a Lodge Employees
and their families.
~ OC will commit to the Fund, at minimum, an amount equal to one-half
the number of Lodge units times the County's current "in-lieu" fee at the
time of funding. The ratio of one employee housing unit per every two
lodge units represents the maximum ratio allowed under the provisions
of the County Affordable Housing Polices (Ordinance No. 98-1).
~ OC will use the County of Hawaii's income schedule by family size to
determine eligibility for the Program. The general intent is to award
housing subsidies to people who would qualify under the County's
Income Guidelines (not more than 140% of the County Median Income).
~ fio be eligible for the Program an employee must be an employee of the
project for more than 90 days and must be in good standing. Applicants
cannot own another residence and must be an owner-occupant for the
duration of the loan.
~ A simple application process will be used. Employees interested in
applying for the loan subsidy will provide a completed application prior to
the established application date.
~ OC or a selection committee established by OC, will review applications
and make awards at least annually and, depending on the number of
applications, will prioritize the selection based on need.
~ The loan subsidy may be used to purchase an existing housing unit on
the Island of Hawaii or for construction of a new housing unit. Self-help
housing projects being constructed under a OHCD approved mutual self-
help housing program will also be eligible. An Applicant may also
construct a housing unit on a lot that is owned by the employee or its
family if the Applicant has obtained prior approval of the site by OC.

~ The loan will be secured by a Deferred Sales Price Mortgage in favor of
OC.
~ The loan will be for a period of ten (10) years and will be interest free.
The loan amount will be repaid to the Fund at the time the residence is
sold.
~ If the borrower remains an employee for three years from the date of the
loan closing, then the full amount of the loan will be forgiven.
~ If the residence is not sold within ten years of the date of the loan, the
loan will be released, regardless of whether the employee remained an
employee of the project or an owner occupant.
~ Applicants may participate in other forms of subsidies or housing
programs and still be eligible for participating in the Program.
~ OC shall submit an Annual Report to the Planning Director and OHCD
which provides an accounting of the Fund, number of Applicants and
loans, and nature of the recipients and housing units purchased or built.
~ The term of the Program shall be up to five years, which at OC discretion
may be renewed for an additional five years if the balance of funds has
not been distributed.
~ As an alternative to renewing the Program for a second five-year period,
OC may commit the undistributed balance of funds to the County Office
of Housing and Community Development (OHCD) for use in supporting
affordable housing construction projects on the Island of Hawaii.
