Re: Resolution Creating Position
Enclosed is a resolution creating two (2) Deputy Prosecuting Attorney (Temporary)
positions for the Community Gun Violence Prosecution Program within the Office of
the Prosecuting Attorney. These positions, one for the Hilo Office and the other for
the Kona Office, will be assigned to facilitate the rapid, responsive, and effective
prosecution of serious violent crimes involving guns. The funding for these positions
will be available through the U.S. Department of Justice's Community Gun Violence
Prosecution Program Grant and the State's Criminal Career Program Grant.

A. REQUEST:
Create two deputy prosecuting attorney positions for the Community Gun Violence Prosecution program,
one for Hilo and one for Kona.
BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
The Office of the Prosecuting Attorney applied for and received federal grant funds to implement a
Community Gun Violence Prosecution Program for Hawaii County. The purpose of the program is to
facilitate the rapid, responsive, and effective prosecution of serious violent crimes involving guns.

authorized programs, basis for increased workloads, etc.):
Federal grant funds have been awarded to implement a Community Gun Violence
Prosecution project for Hawaii County. A deputy prosecuting attorney in Hilo and in
Kona will be assigned to facilitate expeditious prosecution of serious crimes of
violence involving guns.
2. Can new duties be assigned to existing positions or handled in other way such as
short term contracts, etc.
No, existing staff will not be able to handle the additional workload to be generated
by the project's strategy.
3. How will new position increase the efficiency/effectiveness of operations? (Use
productivity measurements where possible.):
This deputy prosecuting attorney will focus on serious violent crimes involving guns.
This will improve response time as well as effectiveness in handling violent gun crimes.
In addition, the deputy will work with the Police Department to improve and

implement an intake, case tracking, and data collection system, as well as work
collaboratively with other law enforcement agencies, and conduct relevant training.
4. Alternatives that were considered in lieu of new position. (Have technological
changes been considered?)
There are no technological alternatives to perform the deputy prosecuting attorney
tasks required.
5. Why were manpower needs not planned through budgetary process?
Federal funds were recently awarded to our office following application submitted in
July 2001.
6. List other rationale or pertinent statements and data:
The deputy prosecuting attorney will employ a vertical prosecution strategy to
prosecute serious violent crimes involving guns. This approach provides continuity
and enables development of specialized expertise that will promote effective
prosecution. County funding contraints do not provide adequate staffing to
implement this strategy for gun violence.

Summary of Duties ~i Responsibilities
COMMUNITY GUN VIOLENCE
DEPUTY PROSECUTING ATTORNEY
Provide legal representation for the people of this community before the District Court,
Family Court, Circuit Court, Grand Jury, Intermediate Court of Appeals and the Supreme
Court of the State of I-iawaii.
Responsibilities include case screening, all phases of case preparation and courtroom
presentation. In addition, deputy will assist in development of a case tracking and data
collection process, coordinate law enforcement efforts, and conduct periodic training to
promote expedited and effective case handling for gun violence cases.
