Relating to Streets and Sidewalks
Dear Mr. Arakaki:
Pursuant to Section 3-12 of the Hawaii County Charter, I am disapproving Bill 225 Draft 6
and returning it to you.
This bill repeals the existing Chapter 22 of the Hawaii County Code in its entirety and adds a
new Chapter 22 entitled "County Streets." I am reluctantly taking this action for several
reasons.
The first is related to the building numbering requirements found in Article 5, Division 2. The
intent of this section is to help emergency responders locate residences and businesses
expeditiously by requiring the numbering of all buildings in the County which are occupied
for residential purposes or used as a place of business. A review of this section, though,
indicates that the way it is presently written, it does not accomplish its intent.
Second, also related to building numbering, is the need to have a transition or phase-in period
for this provision. Bill 225 Draft 6 as written takes effect upon approval. This means that
overnight, most of the people in the C€~anty outside of the Hilo and Kailua urban areas will be
in violatio~l of the law. Additionally, ~~le Building Division has only one person available to
assign nul~lbers to all the homes and businesses that will require them. A transitional phase-in
period is critical to this mandate.
Last, I have concerns about the severity of the penalties included in Article 8, especially since
these penalties apply to violations of any provision of this chapter. For example, a person
who does not number his house as required can be subject to a civil fine of not less than $500
and not more than $1,000 for each day the violation persists, as well as be subject to criminal
prosecution, and upon conviction subject to an additional fine of not less than $500 and not 11

more than $1,000. I also have reservatsons about the provision that fines or County costs
unpaid for one year become a lien upon the subject property.
Because of the importance of the other issues addressed by Bi11 225 Draft 6, I will be
resubmitting a new proposal that addresses these concerns as soon as possible. Thank you for
