A RESOLUTION AUTHORIZING THE MAYOR TO NEGOTIATE AND EXECUTE AN
AGREEMENT WITH OCEANSIDE 1250, TO SATISFY CONDITION "M" OF
ORDINANCE NO. 97-36.
WHEREAS, Oceanside 1250 owns land in North Kona, Hawaii,
covered by tax map keys (3)8-1-4: portion of 3, (Property); and
WHEREAS, Condition "M" of Ordinance No. 97-36 states that
"The applicant shall establish a program for employee housing
which shall be submitted for the review and approval of the
Planning Director and Housing Agency together with the submittal
of plans for Plan Approval for the proposed lodge. The program
shall include provisions for on-site or off-site housing for the
employees of the lodge in an amount to be determined by a study
of surrounding housing opportunities and employee needs. The
program may also include consideration for other alternatives
such as -rental housing subsidies or housing allowances. The
approval of the program shall be secured prior to the issuance
of a certificate of occupancy of the lodge within the subject
area."
WHEREAS, on December 3, 2001, as part of the Change of Zone
No. 97-36, Oceanside 1250 submitted the proposed housing plan
for approval by the Planning Director; and

WHEREAS, the Hawaii County Housing Agency approved the
attached Housing Plan pursuant to Chapter 11, Section 11-5(d) of
the Hawaii County Codes.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII that the Mayor is hereby authorized to negotiate and
execute an agreement with Oceanside 1250 to satisfy Condition
"M" of Ordinance 97-36.
BE IT FURTHER RESOLVED, that a copy of this resolution be
transmitted to the Office of Housing and Community Development,
the Planning Department and Oceanside 1250.
