Your Committee on Finance, to which was referred Bill No. 190, reports as follows:
Bill No. 190, transmitted by Director of Finance William Takaba, via Communication No. 546, dated March
6, 2002, amends Ordinance No. Ol -55, as amended, the Operating Budget, ending June 30, 2002. The
amendment is as follows:

These funds will by used to supplement the funding of two Deputy Prosecuting Attorney positions, one in the
Hilo office and one in the Kona office for athree-year term. These positions will be assigned to prosecute
serious violent crimes involving guns.
Pursuant to Section 46-7, I-lawai`i Revised Statutes, and Section 13-13{b), Hawaii County Charter, the
Mayor is hereby authorized to apply for, receive and expend the funds for the program(s) identified in
Section 1.
During its discussion, Your Committee questioned the procedure of accepting the funds and authorizing the
Mayor to sign the contract. This new procedure implemented in the operating budget for FY 2001-02, was
explained by the l.,egislative Auditor Constance Kiriu. The procedure combines the funding appropriation
with the Council's authorization to allow the Mayor to sign the contract. In the past, a separate resolution
was used to authorize the contract. A prior Corporation Counsel opinion allowing this combined action will
be transmitted to (:ommittee Members.
Your Committee on Finance is in accord with the purpose and intent of Bill No. 190 and recommends it pass
first reading.
