Your Committee on Parks & Environmental Management, to which was referred Communication No. 541, and
attached Bill No. 187, reports as follows:
The purpose of Bill No. 187 is to amend Chapter 2 of the Hawaii County Code 1983 (1995 Edition), by
adding the Department of Environmental Management Under the Director Supervision of the Managing
Director and deleting Sewer and Solid Waste Functions from the Department of Public Works.
Communication No. 541 is from Galen M. Kuba, PE, Acting Director, Department of Environmental
Management, dated February 26, 2002, transmitting Bill No. 187 for the Council's review and consideration.
Mr. Kuba states that this drab ordinance amends Chapter 2 to recognize the existence of the Department of
Environmental Management. It also recognizes that the Department of Public Works is responsible for all
County public works projects except for those relating to the Department of Water Supply.
Councilmember J. Curtis Tyler, III asked Mr. Kuba to clarify with Corporation Counsel the form and legality
of Section 2-7(a)(3)(B) Police department, to see if it needs to be moved to Section 3, before the bill is heard at
the next Council mccting. Mr. Tyler asked Mr. Kuba if it was his understanding that Section 2-40, item (5)
Acquisition of public and private property for public purposes; being that it was renumbered, if the Department
of Public Works is responsible for the acquisition of all public and private property for public purposes.
Mr. Kuba clarified t1~at it is his understanding of the language. Finally, Mr. Tyler referred to Section 2-40 item
(7) to Mr. Kuba. who stated that the Department of Public Works (DPW) would still oversee the construction
and inspection of projects of the Environmental Management department. Mr. Kuba then went on to clarify
that DPW will only be looking at the engineering aspect of the projects. The planning aspect of the facilities
will still be with the Environmental Management Department.
Your Committee is in accord with the purpose and intent of Bill No. 187, and recommends that it pass first
reading.
