Your Committee on Public Works and Intergovernmental Relations, to which was referred
Communication No. 542 and attached I3i11 No. 188, reports as follows:
The purpose of Bill No. 188 is to amend Chapter 24 of the Hawaii County Code 1983 (1995
Edition), relating to Vehicles and Traffic by deleting Section 24-216.01 pertaining to a flat rate
payment option for parking meter zones in Downtown Hilo.
Communication No. 542, dated February 21, 2002, is from Deputy Director Ronald Ueoka,
Department of Public Works, transmitting Bill No. 188 for the Council's review and
consideration. In his letter, Mr. Ueoka reports the following:
1. Wording in the section is questionable.
2. The flat rate payment option was never implemented internally.
3. Parking meter zones in Downtown Hilo were eliminated in August 2000.
4. The Finance Director concurs with the deletion of subject section.
At the meeting, Casey Yanagihara, Traffic Division Chief and Richard Nishimura, Division
predecessor, chronicled the proposed legislation for Committee Members. According to
Mr. Nishimu:~, the Council implemented the flat rate payment option in 1996 for County
parking met€r zones in Downtown Hilo. The intent of the legislation was to recapture parking
fines collectcs by the State for these zones. The Traffic Division was charged with formulating
rules and procedures necessary to collect such revenues. However, this task was never
completed. In August of 2000, the Council eliminated parking meter zones in Downtown Hilo
rendering the section moot in the process.

During Committee discussion, Council Vice-Chair Tyler expressed his concern over the
Department's failure to implement this law as was directed by Council. In addition, he
questioned whether the proposed language adequately addressed all the existing parking areas in
Hilo.
Councilmember Bobby Jean Leithead-Todd informed the Committee Members that to her
knowledge the flat rate payment option was successfully used only once. In that incident, the
defendant's ticket was dismissed because he had paid the County of Hawaii for the parking
ticket first.
Your Committee is in accordance with the purpose and intent of Bill No. 188 and recommends
that it pass fiat reading.
