Subject: Request for Administrative Time Extension

This is to acknowledge receipt by our office on March 28, 2002 of a request to grant an
administrative time extension pursuant to Condition M of the above referenced ordinance.
The primary reason given for this request is that the clearing of a land title matter is taking longer
than anticipated. However, it is expected that the title will be cleared soon. Since non-
performance is the result of unforeseen conditions and the granting of a time extension is not
contrary to the General Plan, the Zoning Code, or the original reasons for granting the rezoning,
the Planning Director hereby grants a five (5) year administrative time extension. The applicant
shall secure Final Subdivision Approval in compliance with Condition D of Change of Zone
Ordinance No. 97-56 by April 7, 2007.
Please also note that Condition J of the ordinance, which identifies the applicable fair share
contributions for mitigating regional impacts from the development, includes the following
requirement:
"The fair share contribution described above shall be adjusted annually beginning three
years after the effective date of the change of zone, based on the percentage change in the
Honolulu Consumer Price Index (HOPI)." w~

For your information, we are now enforcing the percentage increase based on the HCPI. Since
an administrative time extension does not alter the effective date of the ordinance, that date
remains April 7, 1997.

SUBJECT: INITIAL EXTENSION OF TIME

With reference to Condition M of the subject Ordinance, we respectfully request for an initial
administrative extension oftime of five (5) years to perform all of the conditions in the Ordinance.
The primary reason for our request is we have been in the process of clearing a land title matter that
is taking longer than we anticipated. Although we continue to move forward with the proposed
subdivision project, we did not want to expend large amounts of capital until the title is cleared.
For your information, we expect to clear the title soon. Upon resolution, we will clear/grub the
property, perform a topographic survey ofthe property and then prepare the construction drawings
for the required infrastructure improvements within a year.
The following is an updated progress report on the subject Ordinance:
1. Condition B - We have paid for 18 water units through the Kona Source Agreement II and also
have received a water commitment for 6 additional water units on October 30, 1996. We will
request for a water commitment for the 9 additional water units for Increment II when water units
become available from the Department of Water Supply.
2. Condition D - We were initially granted Tentative Approval of the Preliminary Subdivision
Plat Map fora 34 lot residential subdivision (RS-10) from the Planning Department on July 15,
1998 (Sub 98-070), .and were subsequently granted an extension oftime until July 15, 2003 for
submission of the fnnal plat map and for completion of the improvements.
3. Condition I -The Archaeological Inventory Survey report for the subject property was
approved by the Department of Land and Natural Resources, Historic Preservation Division on July
9, 1997. We are still in the process of developing a preservation plan for the Alanui Kauhini (Old
Government Road) with the State Historic Preservation Division of the Department of Land and
Natural Resources.

4. Condition J - We continue to work with your office to dedicate a portion of the subject
property to the County of Hawaii as the site for a volunteer fire station/community recreational
facility, in lieu of making the equivalent fair share contribution (Refer to the letter from the
Planning Department to Mr. Tom Pack, dated June 28, 2001).
