Dear Ms. Pisicchio:
This is in response to your April 17, 2002 letter concerning the Request for Proposal (RFP) for
Animal Control Services.
In preparing the RFP, our staff consulted with and received recommendations from the Mayor's
Office, Finance Division, and the Legislative Auditor's Office. Specifically, recommendations
concerning the following issues cited in your letter:
• Dixie Kaetsu, Managing Director, indicated that the Mayor wanted the RFP to propose the
option of two contractors providing animal control services separately for East and West
Hawaii.

• Bill Gray, Purchasing Agent, advised the Police Department that it is not customary practice
for RFPs to be reviewed by the County Council prior to being issued. This practice is not
governed by Procurement laws or the County Charter, however is for the protection of the
Council and to maintain the integrity of the proposal process. In having the County Council
review RFPs prior to issuance, would make the specifications available to some interested
vendors prior to final issuance and may give them an unfair advantage over other vendors
who were not present during the Council meeting. Although not the intent, this may taint
the bidding process with some vendors claiming that the winning bid had obtained insight
into the specifications before the issuance of the RFP.
• Bill Gray also advised the Police Department that it is not customary practice for RFPs to be
reviewed by the Corporation Counsel and that solicitation of proposals does not obligate
funds, therefore solicitation of proposals may precede resolution for amulti-year obligation.
• Rory Flynn, Legislative Auditor's Office, worked with staff m developing the first draft of
the RFP, no mention made of RFP having to be reviewed by the County Council or
Corporation Counsel. Co1~m.

• Our department did respond to the March 25, 2002 correspondence from Council Member
Aaron Chung, however inadvertently failed to address these issues at that time. We also
requested that the County Council review Chapter ~ and consider formulating a new animal
control ordinance pursuant to the study conducted by the Officer of the Legislative Auditor.
Staff consulted with Lincoln Ashida, Corporation Counsel on recommendation to have them
review the RFP and although Lester Ishado has been assigned to assist you in this matter, he
indicated that this would be outside of normal practice for a review of proposals by their office.
