Your Committee on Planning, to which was referred Bill No. 192, transmitted jointly with Bill
No. 193 by Mayor Harry Kim, per Communication No. 552, dated March 1, 2002, regarding the
State Land Use Boundary amendment request by David S. I)e Luz Sr., Enterprise ProlFit
Sharing Plan, at Kalaoa 4th, North Kona, Hawaii, TMK: 7-3-05:95, and portion of 31 reports as
follows:
Bill No. 192 amends the State Land Use Boundaries Map, H-7, for the County of 1-lawaii, by
changing the district classification for approximately 12.278 acres of land from an Agricultural
to an Urban zoned district.
The somewhat rectangular-shaped subject property, owned in fee by the applicant and Mr. and
Mrs. James S. Matsumoto, is located west (makai) of Mamalahoa Highway, adjacent and south
of Kona Coastview Subdivision and at the end of Kiekie Street and `Ili`ili Street.
On October 23, 1996, Ordinance No. 96-135 and Ordinance No. 96-136 changed the district
classifications for an 8.943 acre portion of the current 20.988 acre project from the State Land
Use Agricultural to the Urban District and its zoning from an Agricultural (A-Sa) to a Single
Family Residential (RS-10) zoned district. These changes in the district classifications were
made to accommodate a proposed 6-lot residential subdivision consisting of 10,000 square foot
lots and a bulk lot.
The General Plan LUPAG Map designates the land for Urban Expansion, which allows for a mix
of high density, medium density, low density, industrial and/or open designations in areas where
new settlements may be desirable, but where the specific settlement pattern and mix of uses have
not yet been determined.
The Keahole to Kailua (K-to-K) Development Plan, adopted by a County Council Resolution on
April 3, 1991, is a guide to the development of infrastructure and land uses in the region.
The Kona Regional Plan, adopted by a Planning Commission Resolution in 1.984, recommends
the project area for residential uses at a density of four units per acre.
The subject properties.. which are approximately three miles from the nearest coastline, are not
situated within the Special Management Area.

Surrounding properties include the Kona Coastview Subdivision to the north, and the Kona
Palisades Subdivision to the south. These subdivisions, situated within the State Land Use
Urban District and primarily zoned Agricultural (A-Sa), are essentially non-conforming
residential sized lots ranging between 8,000 to 20,000 square feet which include mixed
residential uses and vacant lands. To the east, between the project site and the Mamalahoa
Highway are lands presently zoned A-Sa.
The Land Study Bureau's Detailed Land Classification System rating for this area is "E" or Very
Poor. A soil survey classifies the soil as the Kaimu and Punaluu series. The Kaimu is an
extremely stony peat with rapid permeability, slow runoff and slight erosion hazard. The
Punaluu is an extremely rocky peat, with rapid permeability, slow runoff and slight erosion
hazard. The ALISH system does not classify the soils.
The property is located within Zone X, an area outside the 500-year flood plain.
Committee member Julie Jacobson stated that she sees "no public purpose" to change the
zonings, therefore would vote against the measure.
Your Committee did not entertain further discussion on this measure.
Your Committee concurs with the Planning Commission and the Planning Director for
recommending a favorable consideration for the State Land Use Boundaries amendment request.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 192 and
recommends it pass first reading.
