Your Committee on Planning, to which was referred Bill No. 193, transmitted jointly with Bill
No. 192 by Mayor Harry Kim per Communication No. 552, dated March 1, 2002, regarding the
change of zone request by IDavicl S. I)e Laaz Sr. Enterprise Profit Sharing Plan, at Kalaoa 4th,
North Kona, Hawaii, TMK: 7-3-05: 95, portion of 85 and portion of 31 reports as follows:
Bill No. l 93 amends Section 25-8-3 (North Kona Zone Map), Article 8, Chapter 25 (Zoning
Code), by changing the district classification for approximately 20.988 acres of land from an
Agricultural (A-Sa) and Single Family Residential (RS-10) to a Single Family Residential (RS-
20) zoned district.
The somewhat rectangular-shaped subject property, owned in fee by the applicant and Mr. and
Mrs. James S. Matsumoto, is located west (makai) of Mamalahoa Highway, adjacent and south
of Kona Coastview Subdivision and at the end of Kiekie Street and `Ili`ili Street.
The applicants are proposing to subdivide the project site into thirty-five lots of approximately
20,000 square feet each. The project site is part of a five-lot consolidation and subdivision action
which was granted Final Subdivision Approval on May 10, 2001.
On October 23, 1996, Ordinance No. 96-135 and Ordinance No. 96-136 changed the district
classifications for an 8.943 acre portion of the current 20.988 acre project from the State Land
Use Agricultural to the Urban District and its zoning from an Agricultural (A-Sa) to a Single
Family Residential (RS-10) zoned district. These changes in the district classifications were
made to accommodate a proposed 6-lot residential subdivision consisting of 10,000 square foot
lots and a bulk lot.
The applicants are requesting a State Land Use District Boundary amendment from an
Agricultural to an Urban District for 12.278 acres of land to conform to the rest of the subject
property's zoning.
The 22 lots proposed within Phase I will have access from Ili Ili Street and the remaining 13 lots
in Phase 11 will have access from Kiekie Street. A connector road within the proposed
subdivision will link the two roadways and subdivisions they service. All interior roadways will
be privately maintained.

The General Plan LUPAG Map designates the land for Urban Expansion, which allows for a mix
of high density, medium density, low density, industrial and/or open designations in areas where
new settlements may be desirable, but where the specific settlement pattern and mix of uses have
not yet been determined.
The Keahole to Kailua (K-to-K) Development Plan, adopted by a County Council Resolution on
April 3, 1991, is a guide to the development of infrastructure and land uses in the region.
The Kona Regional Plan, adopted by a Planning Commission resolution in 1984, recommends
the project area for residential uses at a density of four units per acre.
The subject properties, which are approximately three miles from the nearest coastline, are not
situated within the Special Management Area.
Surrounding properties include the Kona Coastview Subdivision to the north, and the Kona
Palisades Subdivision to the south. These subdivisions, situated within the State Land Use
Urban District and primarily zoned Agricultural (A-Sa), are essentially non-conforming
residential sized lots ranging between 8,000 to 20,000 square feet which include mixed
residential uses and vacant lands. To the east, between the project site and the Mamalahoa
Highway are lands presently zoned A-Sa.
The Land Study Bureau's Detailed Land Classification System rating for this area is "E" or Very
Poor. A soil survey classifies the soil as the Kaimu and Punaluu series. The Kaimu is an
extremely stony peat with rapid permeability, slow runoff and slight erosion hazard. The
Punaluu is an extremely rocky peat, with rapid permeability, slow runoff and slight erosion
hazard. The ALISH system does not classify the soils.
Because the property has been grubbed, improved and used as pasture it is unlikely there are any
rare or endangered floral or faunal resources, and archaeological features found within the
property.
The property is located within Zone X, an area outside the 500-year flood plain.
Water is available through the 12-inch waterline which runs along the Mamalahoa Highway.
Sewage will be disposed of through a wastewater treatment system approved by the State
Department of Health.
All other essential utilities and services are available to the subject property, and will be installed
underground.
Bill No. 193, Draft 2, which included language to prohibit the condominium property regimes in
Condition H, the fair share contributions and a minor housekeeping amendment, was circulated
and approved by Your Committee.

Greg Mooers, representative of the applicant, stated that he has not received any phone calls
regarding this measure, and no comments were made at the Planning Commission meeting. He
also stated that the applicant has not established a time table for the project.
Your Committee did not entertain further discussion on this measure.
Your Committee concurs with the Planning Commission and the Planning Director for
recommending a favorable consideration for the change of zone request.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 193, Draft 2,
and recommends it pass first reading.
