HomeMy WebLinkAboutREP PC 072 04/02/2002 2000-2002 REPORT OF THE COMMITTEE ON PLANNING DATE: April 2, 2002 RE: C-553 /Bill No. 195 PLACE: Councilroom TIME: 1:47 p.m. Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No. 195, transmitted jointly with Bill No. 194 by Mayor Harry Kim, per Communication No. 553, dated March 1, 2002, regarding the change of zone request by Ellen M. Garver, at Kalaoa 4th, North Kona, Hawaii, TMK: 7-3-05:30, reports as follows: Bill No. 195 amends Section 25-8-3 (North Kona Zone Map), Article 8, Chapter 25 (Zoning Code), by changing the district classification for approximately 3.129 acres of land from an Agricultural (A-Sa) to a Single Family Residential (RS-20) zoned district. The somewhat rectangular-shaped subject property, owned in fee by the applicant, is located west (makai) of Mamalahoa Highway, adjacent and south of Kona Coastview Subdivision and at the end of Leimomi Street. There is an existing farm dwelling located within the proposed Lot 1-C near the middle of the project site and a farm workshop and greenhouse within proposed Lot I-A adjacent to the Mamalahoa Highway. The remainder of the site is vacant and was previously utilized for pasture. The applicant is proposing to subdivide the project site into five lots of approximately 20,000 square feet each. Four lots will have access from Leimomi Street through the Kona Coastview Subdivision, while the remaining lot, which lies adjacent to the Mamalahoa Highway, will gain access directly to the highway via an existing driveway. The extension of Leimomi Street will be privately maintained with a 50-foot wide right-of--way and 20 feet of pavement width. The applicant states that deed covenants for each of the 5 proposed lots will prohibit the construction of ohana dwellings. The subject property is situated within the State Land Use Agricultural District. The General Plan Land Use Pattern Allocation Guide (LUPAG) Map designates the area for Urban Expansion, which allows for a mix of high density, medium density, low density, industrial and/or open designations in areas where new settlements may be desirable, but where the specific settlement pattern and mix of uses have not been determined. The Keahole to Kailua (K-to-K) Development Plan, adopted by Resolution on April 3, 1991, by the County Council, designates the area for Residential Expansion. The Kona Regional Plan, adopted by the Planning Commission in 1984, recommends the project area for residential uses at a density of four units per acre. The subject property, located approximately 3 miles from the nearest coastline, is not within the Special Management Area of the County of Hawaii. Surrounding properties include the Kona Coastview Subdivision to the north, and the Kona Palisades Subdivision to the south. These subdivisions, situated within the State Land Use Urban District and primarily zoned Agricultural (A-Sa), are essentially non-conforming residential sized lots ranging between 8,000 to 20,000 square feet. These subdivisions include mixed residential uses and vacant lands. PC-72 PC-72 -2- April 2, 2002 The Land Study Bureau's Detailed Land Classification System rating for this area is "E" or Very Poor. A soil survey classifies the soil as the Kaimu and Punaluu series. The Kaimu is an extremely stony peat with rapid permeability, slow runoff and slight erosion hazard. The Punaluu is an extremely rocky peat, with rapid permeability, slow runoff and slight erosion hazard. The ALISH system does not classify the soils. Because the property has been grubbed, improved and used as pasture it is unlikely that there are any rare or endangered floral or faunal resources and archaeological features found within the property. The property is located within Zone X, an area outside the 500-year flood plain. Water is available through the 12-inch waterline which runs along the Mamalahoa Highway. Sewage will be disposed of through a wastewater treatment system approved by the State Department of Health. All other essential utilities and services are available to the subject property. Bill No. 195, Draft 2, which included language to prohibit the condominium property regimes in Condition H, the fair share contributions and a minor housekeeping amendment, was circulated and approved by Your Committee. Committee Member Julie Jacobson stated that she sees "no public purpose" to change the zonings, therefore would vote against the measure. For information purposes only, on the final vote, Committee Member Nancy Pisicchio voted "kanalua" twice. Your Committee did not entertain further discussion on this measure. Your Committee concurs with the Planning Commission and the Planning Director for recommending a favorable consideration for the change of zone request. Your Committee on Planning is in accord with the intent and purpose of Bill No. 195, Draft 2, and recommends it pass first reading.
