Your Committee on Finance, to which was referred Bill No. 201, reports as follows:
Bill No. 201, transmitted jointly with Bill No. 200 by Acting Director Galen M. Kuba, via
Communication No. 567, dated March 18, 2002, amends Chapter 21 of the Hawaii County
Code, 1983 (1995 edition), relating to sewer service charges.
Bill No. 201 proposes to transfer the sewer service charges rate setting authority from the County
Council to the Environmental Management Commission.
Your Committee heard testimony in opposition to the measure from Mr. Mike DuBois and
Mr. Steven Araujo. Also, speaking in favor to the measure was Mr. Jon Olson and
Mr. Hugh Ono.
Although this measure would provide relief to the County Council, Some Members of Your
Committee agreed that the authority to set the sewer service charges should be keep with the
County Council.
An amendment to the Hawaii County Charter was approved by a majority of Big Island voters
on November 7, 2000, which created the Environmental Management Commission. The intent
of this commission is to advise the Department of Environmental Management on waste
reduction strategies, recycling, litter control, community involvement, and other issues relating
to the functions of the department. Also, the Environmental Management Commission has the
right to exercise any other powers related to the functions of the department that may be
delegated to it by ordinance. Council Members suggested that the Commissioners submit a
proposal to voters to extend the role beyond an advisory role.
Your Committee on Finance is not in accord with the purpose and intent of Bill No. 201 and
recommends it be filed.
