RESOLUTION AUTHORIZING THE SALE BY NEGOTIATION OF THE FORMER
HAMAKUA SUGAR COMPANY, INC. LANDS NOW UNDER COUNTY OWNERSHIP IN
ADDITION TO THE AUTHORIZATION PROVIDED IN RESOLUTION NO. 161-02 (SALE
BY AUCTION, LAND EXCHANGE BY NEGOTIATION, AND SHORT-TERM LEASE BY
AUCTION, SEALED BIDS OR NEGOTIATION}.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII:
WHEREAS, the Council of the County of Hawaii, by Resolution No. 161-02, adopted
on January 24, 2002, authorized the Finance Director or authorized representative "to proceed
with the sale by auction or exchange by negotiation, as long as the public interest demands it, on
a value-for-value basis, of so much as may be necessary of the former Hamakua Sugar
Company, Inc. lands now under County ownership which are delineated on the list labeled
Exhibit "A" for so much as may be necessary of those certain properties under private ownership
which are delineted on the list labeled Exhibit "B" or for other lands as they may become
available;" and
WHEREAS, Resolution No. 161-02 further authorized "the short-term leasing of those
County lands delineated on Exhibit "A" for pastoral use by auction, sealed bids or negotiation;"
and
WHEREAS, since Resolution No. 161-02 was adopted, the Finance Director established
a `Land Management Committee,' composed of county personnel with expertise or interest in the
County's management of its real property resources, for the purpose of reviewing County land
management issues and making recommendations to the Finance Director; and
WHEREAS, the `Land Management Committee' along with real estate agents conducted
a site visit, and learned in discussion that the County would receive a better value for its land
through sale by negotiation, rather than by auction, given the number ofpre-existing Iots
determined for the properties and other considerations; and
WHEREAS, the Council of the County of Hawaii finds that the public interest demands
that the sale of the County's Hamakua Sugar Company's land obtain the highest value and best
return potential in view of the circumstances surrounding the properties, which may best be
achieved through a negotiated sale.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that it finds the public interest demands the sale of the County's Hamakua Sugar
Company, Inc. lands by negotiation because it will obtain the highest value and best return
potential in view of the circumstances surrounding the properties.
BE IT FURTHER RESOLVED that, pursuant to Section 2-114(a), Hawaii County Code,
it approves of and directs the Finance Director or authorized representative to proceed with the
sale by negotiation, as long as the public interest demands it, of so much as may be necessary of
the former Hamakau Sugar Company, Inc. lands now under County ownership which are set
forth in Resolution No. 161-02.
BE IT FURTHER RESOLVED that this authorization to sell property by negotiation
shall be in addition to the authorization given in Resolution No. 161-02 in order to afford
maximum administrative flexibility for the disposition of the subject lands in the best interest of
the public.
BE IT FINALLY RESOLVED that copies of this resolution be transmitted to the
Honorable Harry Kim, Mayor of the County of Hawaii, and the Director of Finance.
