While Veriz®n Hawaii supports the general intent of this measure, w€~ do have a concern regarding the requirarptent in Section 22-~.~(h) which mandates that all repair, restoration, or replacement work comply with the current requirements of the Americans With ®isabilities Act (A®A) regardless of c~xisting conditions. We believe that in certain situations, this mandate nay transform a single utility pole repair int®a sign cant cvnstructi®n project. It is our understanding that llawaii County standards currently require utility poles to be located one~and-a-half t® two feet from the curb of the street, T"he AIaIA also has nlinirrtum clearance standards for all conforming sidewalks. If a utility p®le in need of repair is located on a sidewalk that did not have enough clearance to accon'~m®date both the Gounty curb to pule and the ADA clearance requirements, and if that sidewalk is immediately abutted by private property, this bill may necessitate conderrsnation of a APR-30-2002 16:24 FROM:REG.& GOUT. Verizon ~Oawaii believes that an amendment to authorize the iJirector ®f public Works to exempt repair, restoration, or replacement work from corr?plying with current requirements of A®l~e if the exemption is in the overall interest of the general public would provide the administrative flexibility to address the above rnentloned, or similar circumstances. With the incorporation of this artlendm®nt, Section 22.4 (h) would read as follows: ~Secfiion 226.4 Construcfiion p®rmits; conditions.
