RESOLUTION AUTHORIZING THE PARTIAL RELEASE OF A DRAINAGE
EASEMENT ON PROPERTY OWNED BY ALBERT GALIMBA REVOCABLE
LIVING TRUST AND MILDRED K. GALIMBA REVOCABLE LIVING TRUST,
TMK: (3) 9-6-5: PORTION OF 46.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII:
WHEREAS, the County of Hawaii is the "Easement Holder" of a drainage
easement over TMK: 9-6-5: 46, acquired in 1992 for the Pa`au`au Stream Flood Control
Project; and
WHEREAS, the Albert Galimba Revocable Living Trust and the Mildred K.
Galimba Revocable Living Trust are the owners of TMK: 9-6-5: 46; and
WHEREAS, the State of Hawai`i's Department of Transportation, Highways
Division requires release of that portion of the drainage easement over the portion of
TMK: 9-6-5: 46 identified as Parcel 7 (Revision 1), shown on Exhibit A, for its
Mamalahoa Highway, Emergency Replacement of Pa`au`au Stream Bridge, Federal Aid
Project No. ER-12(3) at Pa`au`au 2"d, Ka`u, Island of Hawaii; and
WHEREAS, upon completion of the said Bridge Replacement project, the State of
Hawaii intends to turn over, free of charge, Parcel 7 (Revision 1) to the County of
Hawaii for drainage purposes; and
WHEREAS, the Director of Public Works, on behalf of the Easement Holder, with
his signature on the proposed Warranty Deed between the Galimba Trusts and the State of
Hawaii, which Warranty Deed incorporates the release of the subject easement,
recommends approval of the release of easement; and
WHEREAS, the County, pursuant to Section 2-120, Hawaii County Code, is
authorized to dispose real property to governments without appraisal; and
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
COUNTY OF HAWAII that the Council hereby authorizes the release of that portion of
the drainage easement over Parcel 7 (Revision 1) as shown on Exhibit A.
BE IT FURTHER RESOLVED that copies of this resolution be sent to the Finance
Director, Director of Public Works and the Mayor for disposal of this subject easement
portion
