Subject: Written testimony in support of filing date exemptions and exemption on minimum
lot size.
Dear Mr. Arakaki,Chairman,
You will soon receive a report from the Planning Department regarding a proposed CPR bill.
I am writing to you regarding that upcoming bill. I am in favor of the exemptions in the proposed
CPR Bill which exempts two (2) unit condominium projects with either (a) have a declaration of
condominium property regime which was filed on or before June 19, 2001 or (b) have two or more
legal dwellings (not sheds) which are either completed or have valid building permits.
Also, I am in favor of exempting minimum lot size for the CPR filers who have been caught in
limbo with the drafting of this proposed CPR Bill by Chris Yuen. The minimum lot size was not a
requirement when I filed.
In my case and cases like mine where all the documents and approvals have been completed, I
believe it is excessively punitive to prohibit the final approval. In addition, my attorney Wendelin L.
Campbell and I have meticulously done everything asked of us under State of Hawaii laws during
the CPR formation. I have incurred thousands of dollars in fees.
If there is to be a change in a CPR law, by the proper agency, it should ~ be retroactive and
punitive to those who have in good faith followed each and every step the State of Hawaii laws
required. The parcels have already received State of Hawaii Property Tax and Assessment
sanction by receiving separate property and separate tax bills.
Since I followed all the legal rules and incurred significant expenses, I trust that if a law is being
changed, it will not apply to cases like mine that are essentially completed.
Therefore, I respectfully request that if you are going to create a new CPR bill that you at least
allow those in mid process the ability to finish their CPR exempting minimum lot size as this was
not a criteria during my initial filing.
