KANAZAWA TEI RESTAURANT ORDINANCE N0. 88 125 TMK: 7-5-09:39 From Planning Director Duane Kanuha dated April 17, 1989, regarding the imposition of Condition E of Ordinance 88 125 to provide curbs, gutters, sidewalks and other related improvements fronting the property of Oku Vision World Co., Ltd. (Kanazawa Tei Restaurant), when development occurs on either of the adjoining properties or upon demand of the County Council. Since the Kurashige Trust Estate property is situated adjacent to the Oku property, requests that they be informed at what point in time would the requirements be imposed or whether the Council is demanding that the improvements be provided at this time. Informs the Planning Commission also voted to approve an amendment to the Special Management Area (SMA) boundary for the affected area. PC-8 Page 4 May 10, 1989 Comm. 101: AGRICULTURAL CONDOMINIUM Copy of letter to Planning Director Duane Kanuha from Mark Van Pernis of Gallup & Van Pernis, Attorneys At Law, dated December 27, 1988, informing of an attempt to create an "Agricultural Condominium", which he feels, if successful, would not be in compliance with applicable subdivision law and would result in property being used as a subdivision and burdening County or State governmental services without any compliance with applicable subdivision law or providing needed infrastructure. States the Legislature should revise its Horizontal Property Regime laws to preclude use of agricultural land fur any kind of "condominium" and that the County, particularly the Planning Department, should recognize "agricultural condominiums" for what they are, i.e. subdivisions, and not allow them to take place without meeting all applicable subdivision laws. Informs the Commission concurs with the Planning Director in recommending denial of the application for reasons, as listed. Comm. 351: From Planning Director Duane Kanuha dated March 16, 1989, informing they have reviewed the modification of David and Ivan Basque's rezoning application and that the new proposal was transmitted to the Department of Public works and the Department of Water Supply (DWS) PC-8 Page 5 May 10, 1989 (Comm. 351) for review and comment. States, even with the new -cont'd- proposal, DWS informs that the existing water system facilities cannot support the proposed development; as such, Planning Department is maintaining their denial recommendation. Comm. 462: From Planning Director Duane Kanuha dated May 1, 1989, transmitting copy of a letter from the Department of water Supply to David Basque indicating that water is now available to accommodate his revised development plans, therefore, informs they are in support of the change of zone request. Comm. 435: Copy of letter to Chief Engineer Hugh Y. Ono from Harold Spector, Partner, Alii Village, dated April 20, 1989, informing that they agree that the northern driveway for the proposed development will not be less than 50 feet between centers of radii and will be set near the 100 feet presently planned; further, they agree to provide for a future driveway to the contemplated connector road to the new Alii Drive alignment, presently in the EIS process. Also states they understand that the eastern driveways to the new alignment, when constructed, will be allowed as right turn-in and out only due to the median construction.
