1989, regarding the imposition of Condition E of
Ordinance 88 125 to provide curbs, gutters, sidewalks
and other related improvements fronting the property of
Oku Vision World Co., Ltd. (Kanazawa Tei Restaurant),
when development occurs on either of the adjoining
properties or upon demand of the County Council. Since
the Kurashige Trust Estate property is situated
adjacent to the Oku property, requests that they be
informed at what point in time would the requirements
be imposed or whether the Council is demanding that the
improvements be provided at this time.

Copy of letter to Planning Director Duane Kanuha from
Mark Van Pernis of Gallup & Van Pernis, Attorneys At
Law, dated December 27, 1988, informing of an attempt
to create an "Agricultural Condominium", which he
feels, if successful, would not be in compliance with
applicable subdivision law and would result in property
being used as a subdivision and burdening County or
State governmental services without any compliance with
applicable subdivision law or providing needed
infrastructure.
States the Legislature should revise its Horizontal
Property Regime laws to preclude use of agricultural
land fur any kind of "condominium" and that the County,
particularly the Planning Department, should recognize
"agricultural condominiums" for what they are, i.e.
subdivisions, and not allow them to take place without
meeting all applicable subdivision laws.
