Your Committee on Planning, to which was referred Bill No. 203, transmitted jointly with Bill
No. 202 by Mayor Harry Kim, per Communication No. 573, dated March 25, 2002, regarding the
change of zone request by Th®anas C. and F. Ann Hi11, at Ouli, South Kohala, Hawaii,
TMK: 6-2-11:26, reports as follows:
Bill No. 203 amends Section 25-8-7 (North and South Kohala Zone Map), Article 8, Chapter 25
(Zoning Code), by changing the district classification for approximately 5.248 acres of land from
an Agricultural (A-Sa) to a Residential and Agricultural (RA-2a) zoned district.
The flag shaped lot, owned in fee by Hill Family Trust and Mark N. Holmes, is located in the
Anekona Estates Subdivision approximately three-eighths of a mile south of the Kawaihae Road,
at the end of Aho Place and bordered by Keanuiomano Stream. The applicants propose to
subdivide the property into two lots, each with atwo-acre minimum. There is an existing
dwelling near the front portion of the parcel.
The General Plan LUPAG Map classification is Extensive Agricultural, which permits pasture
and range land usage. The property and surrounding areas were previously zoned Unplanned;
however, with the adoption of the 1996 Zoning Code, the parcel was reclassified to Agricultural-
5 acre.
The subject parcel is located six miles from the nearest coastline, so it is not located within the
Special Management Area.
The 36 unit Anekona Estates Subdivision, created on October 23, 1990, presently consists of 42
parcels. Planning Department records indicate Ohana Dwelling permits were issued for 12 lots,
and Real Property Tax Records indicate there are 14 lots, including the subject property, with
condominium property regimes.
The 26 lot Kanehoa Subdivision, created on April 29, 1985, has 16 lots with Ohana Dwelling
permits; and according to Real Property Tax Records, 141ots have Condominium Property
Regimes.

Lands immediately to the east and west of the property have been redesignated to Rural and
zoned Residential and Agricultural (RA-2a) by the County. The adjacent parcels to the north are
five acre parcels within the State Agricultural District, zoned Agricultural (A-Sa) by the County,
and include mixed residential uses and/or vacant lands The l O lot Kamuela Plantations
Subdivision, located further to the east, and the 261ot Waimea Landmark Estates Subdivision,
located across the Kawaihae Road and further to the northeast, include mixed residential uses,
vacant lands and very few residential/agricultural uses. The Ouli Ekahi 33-unit affordable rental
housing project is located to the west of Anekona Estates and is in the State Land Use Urban
District. The Hale Wailani property, adjacent to and west of Anekona Estates and the housing
projects, is currently zoned A-1 a with a proposed 49 two-acre minimum lot subdivision.
The ALISH System designation for the property and surrounding area is "Unclassified". The
Land Study Bureau's Detailed Land Classification System classifies the soils within the property
and surrounding area as "E" or "Very poor" for agricultural productivity. The US Soil Survey
classifies the soils as Puu Pa, an extremely stony very fine sand loam with moderately rapid
permeability, medium runoff and moderate erosion hazard used mostly for pasture.
There are no known or recorded rare or endangered animal or plant life in the area; and there are
no known archaeological, cultural or historic sites located on the property.
The property is located within Zone X, an area outside the 500-year flood plain.
Access to Anekona Estates is from Kawaihae Road via Anekona Street. Direct access to the
property is from Aho Place, a cul-de-sac.
Water is available through the two one-inch service laterals, both of which have a 5/8 inch meter.
The subject parcel is located in a Critical Wastewater Disposal Area, and since there is no
municipal sewer system, wastewater will be disposed of in a septic tank system in accordance to
Department of I-Iealth regulations.
All other essential utilities and services are available to the subject property.
Committee Member Julie Jacobson stated that because she sees no public outcry for this change
of zone request, she will vote against the measure.
Your Committee did not entertain further discussion on this measure.
Your Committee concurs with the Planning Commission and the Planning Director for
recommending a favorable consideration for the change of zone request.

Your Committee on Planning is in accord with the intent and purpose of Bill No. 203, and
recommends it pass first reading.
