A RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL
YEAR AND OF MORE THAN ONE FISCAL YEAR FOR ANIMAL CONTROL
SERVICES
WHEREAS, Section 10-11 of the County Charter requires that any contract,
lease or other obligation requiring payment of funds from the appropriations of a later
fiscal year or more than one fiscal year be approved by resolution; and
WHEREAS, HRS Chapters 46 and 143, and Chapter 4 of the Hawaii County
Code authorize the County to regulate a variety of animal control activities; and
WHEREAS, HRS Section 143-15 allows the County to contract with any society
or organization formed for the prevention of cruelty to animals for the seizure and
impoundment of all unlicensed dogs and for the maintenance of a shelter or pound; and
WHEREAS, Section 4-f of the Hawaii County Code authorizes the County
Council to appropriate funds for stray dogs, cats and small domesticated animals and
for the assistance of societies to accomplish the related responsibilities which are
delegated to the societies; and
WHEREAS, the County wishes to contract with such an organization for animal
control activities; and
WHEREAS, the County finds that for economic and practical reasons, it is in the
best interest of the County that the contract for animal control services covers more
than one year; and
WHEREAS, the County will issue a Request for Proposal seeking to contract with
one organization to provide island-wide animal control services for a period up to
June 30, 2005 with the option of extending the contract in increments of two one-year
periods ending June 30, 2007.
NOW, THEREFORE, 13E IT RESOLVED SY THE COUNCIL OF THE COUNTY
OF HAWAII:
1. That the Mayor be authorized to execute amulti-year contract with one
organization to provide animal control services for the County of Hawaii.
2. That sufficient funds be budgeted in future fiscal years to cover the
anticipated obligation of the County under the animal control contract.
BE IT FURTO-IER RESOLVED that this authorization to execute amulti-year
contract shall be limited to one island-wide contract only.
BE IT FINALLY RESOLVED that a copy of this resolution be transmitted to the
Office of the Mayor, Police Department, and the Department of Finance.
